About introduction of amendments to the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of April 15, 2022 No. 123 "About approval of Rules of issue, prolongation and withdrawal of permission to the labor immigrant"

1. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of April 15, 2022 No. 123 "About approval of Rules of issue, prolongation and withdrawal of permission to the labor immigrant" (it is registered in the Register of state registration of regulatory legal acts at No. 27595) the following changes:

The rules of issue, prolongation and withdrawal of permission to the labor immigrant approved by the specified order (further – Rules) to be reworded as follows according to appendix 1 to this order.
2. To provide to committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;
3) within three working days submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of subitems 1) and 2) Item 2 of this order;
4) bringing this order to data of the Ministry of Internal Affairs of the Republic of Kazakhstan, akimats of the capital, areas and the cities of republican value for management in work.
3. To impose control of execution of this order on the first vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

"2) nationality of the foreign citizen to conditions the provided subitem 1) Item 1 of article 43-1 of the Law of the Republic of Kazakhstan "About population shift";";

1. For registration of permission the following documents are provided to the labor immigrant: 1) the statement for issue of permission to the labor immigrant certified by the EDS of the labor immigrant and the employer; 2) electronic copies of the receipt on payment of preliminary payment on the individual income tax according to the tax legislation of the Republic of Kazakhstan; 3) the electronic passport copy with mark (Amy) about crossing of Frontier of the Republic of Kazakhstan for the last 12 months; 4) the electronic copy of the medical certificate about the state of health of the foreign citizen, stateless person, migrant, migrant worker (including from state member of EEU) (the medical certificate of form 028/at which date of issue does not exceed 12 months); 5) the electronic copy of the imputed health insurance covering primary health care and specialized medical care in stationary conditions in the emergency form on the conditions established by the laws of the Republic of Kazakhstan with effective period, at the least the term specified in the statement and registered in the automated information system "Single Insurance Database"; 6) the electronic copy of the agreement of intent of execution of an employment agreement with the employer in the Republic of Kazakhstan, constituted between the employer - physical person and uslugopoluchatel. 2. For prolongation of permission: 1) the statement for prolongation of permission to the labor immigrant certified by the EDS of the labor immigrant and the employer; 2) electronic copies of the receipt on payment of preliminary payment on the individual income tax according to the tax legislation of the Republic of Kazakhstan; 3) the notarized passport copy with mark (Amy) about crossing of Frontier of the Republic of Kazakhstan for the last 12 months; 4) the electronic copy of the imputed health insurance covering primary health care and specialized medical care in stationary conditions in the emergency form on the conditions established by the laws of the Republic of Kazakhstan with effective period, at the least the term specified in the statement and registered in the automated information system "Single Insurance Database"; 5) the electronic copy of the employment contract with the employer in the Republic of Kazakhstan, constituted between the employer and uslugopoluchatel according to the Labor Code of the Republic of Kazakhstan. |
