Article 4. Early termination of powers of Kurultai

1. The president of the Republic of Kazakhstan has the right to dismiss Kurultai after consultations with the Chairman of Kurultai and the Prime Minister.

2. The president of the Republic of Kazakhstan has the right to dismiss Kurultai in case of repeated refusal in consent on appointment of the candidacy proposed by the President for position, appointment to which is performed with the consent of Kurultai, and also in case of repeated refusal in election of the Chairman of Kurultai.

3. The kurultai cannot be dismissed in the period of emergency or warlike situation, in the last six months of powers of the President, within one year after the previous dissolution or in case, stipulated in Item 3 articles 51 of the Constitution of the Republic of Kazakhstan.

Article 5. Structure of Kurultai

2. The procedure for election of deputies of Kurultai is established by the constitutional law.

Article 6. Powers of Kurultai Kurultai:

1) adopts the constitutional laws and the laws;

2) takes repeated discussion and vote on the laws or articles of the law which caused objections of the President of the Republic of Kazakhstan;

3) resolves issues of war and peace;

4) makes according to the proposal of the President of the Republic of Kazakhstan the decision on use of Armed Forces of the Republic of Kazakhstan for accomplishment of the international obligations on peacekeeping and safety;

5) announces election of the president of the Republic of Kazakhstan;

6) announces initiative about purpose of national referendum;

7) agrees to the President of the Republic of Kazakhstan to appointment of the Vice-president of the Republic of Kazakhstan;

8) agrees to the President of the Republic of Kazakhstan to appointment of the Prime Minister of the Republic of Kazakhstan;

9) agrees to appointment of judges of the Constitutional Court as the President of the Republic of Kazakhstan, members of Central Election Commission, the Highest auditor chamber;

Chooses 10) and dismisses judges of the Supreme Court of the Republic of Kazakhstan on representation of the President of the Republic of Kazakhstan, takes their oath;

11) deprives of immunity of judges of the Constitutional Court, judges of the Supreme Court;

12) stops powers of the deputy of Kurultai, and also on representation of the Attorney-General of the Republic of Kazakhstan resolves issues of deprivation of the deputy of Kurultai of its immunity;

13) at the initiative of at least one heel from total number of deputies of Kurultai to the Government having the right to express by a majority vote from total number of deputies of Kurultai non-confidence vote;

14) hears annual messages of the Constitutional Court about condition of the constitutional legality in the Republic of Kazakhstan;

15) two times a year hear the report of the Chairman of the Highest auditor chamber;

Discusses 16) and approves reports of the Government and the Highest auditor chamber on execution of the republican budget;

17) has the right to hear at the initiative of at least one third of total number of deputies of Kurultai reports of members of the government of the Republic of Kazakhstan concerning their activities;

Carries out 18) concerning the competence of hearing and government hours;

19) is accepted by regulations of the activities and other decisions on the questions connected with the organization and internal rules and procedures of Kurultai;

Creates 20) coordination and working bodies of Kurultai;

21) forms the commissions of Kurultai, chooses and dismisses chairmen, hears activities reports of the commissions;

22) performs other powers assigned to Kurultai by the Constitution of the Republic of Kazakhstan.

Article 7. Work languages in Kurultai

Use of languages in work of Kurultai is performed according to the Constitution of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan on languages.

Article 8. International cooperation of Kurultai

The kurultai performs international cooperation with parliaments of foreign states, the international and inter-parliamentary organizations according to the procedure, provided by Regulations of Kurultai.

Chapter 2. Organizational forms of implementation of activities of Kurultai

Article 9. Sessions of Kurultai

1. The session of Kurultai takes place in form of meetings.

2. The first session of Kurultai is convened by the President of the Republic of Kazakhstan no later than thirty days from the date of publication of results of elections.

3. The Chairman of Central Election Commission of the Republic of Kazakhstan presides over the first session of Kurultai before election of its Chairman at meetings.
