About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on control and the prevention of abuse of alcohol, illegal consumption of drugs and other psychotropic substances No. 713/2001 (Official monitor of the Republic of Moldova, 2002, Art. No. 36-38, 208), with subsequent changes and amendments, to make the following changes and addition:
1. In article 1 to state the concept "conducting testing for alcohol" of the following edition:
"conducting testing for alcohol – the actions of the police officer or other authorized person which is specially trained by competent medical institution directed to determination of quantitative content of alcohol in exhaled tested-faced air, without determination of state of intoxication and its nature, performed by means of the approved and confided technical means.".
2. In part (1) Article 4:
in Item d) change concerns only the text in state language;
in Item е) words "alcoholic or drug addiction," shall be replaced with words "alcoholic and/or drug addiction,".
3. In Article 5:
in the name of the word of "alcoholic and drug addiction" shall be replaced with words "alcoholic and/or drug addiction";
in the prolog of the word "with alcoholic and drug addiction" shall be replaced with words "with alcoholic and/or drug addiction,".
4. In Article 13 to replace the word "drugs" with the word "narcotic".
5. Part (2-4) articles 17 after the word "are permitted" to add with the words "with observance of the compulsory preliminary procedure", and words of "Ministry of Health". shall be replaced with words ", being under supervision of the Ministry of Health.".
Art. II. – In Item 3 of article 10 of the Law on entrepreneurship and the companies No. 845/1992 (The official monitor of the Republic of Moldova, 1994, No. 2, of the Art. 33), with subsequent changes and amendments, change concerns only the text in state language.
