About modification of some legal acts of Ukraine concerning increase in pensions

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In article 85 of the Law of Ukraine "About provision of pensions" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 3, Art. 10; 2015, No. 22, Art. 145; 2016, No. 5, Art. 50; 2017, No. 2, Art. 25):

1) in part four:

in paragraph one of figure and the word "December 31" to replace with figures and the word "September 30";

in paragraphs second and third words and figures of "disabled people of I and II groups, disabled veterans" shall be replaced with words also in figures "persons with disability of I and II groups, persons with disability owing to war";

Part the sixth to state 2) in the following edition:

"Since October 1, 2017 pensions are paid without the received salary (income)".

2. In the Law of Ukraine "About the status and social protection of citizens which suffered owing to the Chernobyl catastrophic crash" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 13, Art. 178 with subsequent changes):

Article 49 to add 1) with part two of the following content:

"After January 1, 2015 additional pension for the harm done to the health, faces referred to category 4, is not established";

Paragraph one of part one of Article 55 to state 2) in the following edition:

"Of pension the stipulated in Clause 26 Laws of Ukraine "About obligatory national pension insurance", in the presence of the corresponding insurance years of service reduced on the number of years of reduction of retirement age, but at least 15 years of insurance years of service are provided to persons who worked or lived in the territories of radioactive pollution with reduction of retirement age,";

3) in Article 56:

add Item 2 with words and figures "in case of award of pension on favorable terms parts two of article 27 of the Law of Ukraine "About obligatory national pension insurance";

in Item 3 of the word and figures "for 10 years" shall be replaced with words bigger stipulated in Item 2 these Articles (women have 25 years, men have 30 years) and in figures "women have 25 years, men have 30 years";

4) in Article 58:

in paragraph one of part one of figure and the word "December 31" to replace with figures and the word "September 30";

third to state part in the following edition:

"Since October 1, 2017 pension payment to the working pensioners during work is resumed in the size established by this Law";

Article 59 to state 5) in the following edition:

"Article 59. Pensions to the military personnel who took part in mitigation of consequences of the Chernobyl catastrophic crash

Pensions to the military personnel are granted from their cash cover according to this Law and other legal acts. Additional pension for the harm done to health is appointed according to article 51 of this Law.

The serviceman of disability pension, and to members of their families of pension in connection with loss of the supporter owing to the Chernobyl catastrophic crash, nuclear accidents and testing, military exercises using nuclear weapon at will can be appointed on conditions and according to the procedure, determined by the legislation for persons who became persons with disability owing to wound, contusion or injuries which they sustained in case of fulfillment of duties of military service (service duties), or according to article 54 of this Law.

To persons who participated in mitigation of consequences of the Chernobyl catastrophic crash, nuclear accidents and testing, in military exercises using nuclear weapon during passing of the active conscription service and thereof became persons with disability, the disability pension is estimated according to this Law or at the request of such persons - from the fivefold size of the minimum wage established by the law for January 1 of the corresponding year";

To replace 6) in the text of the Law of the word "disabled person", "disabled person since the childhood", "handicapped child" and "disabled veteran" in all cases and numbers respectively with the words "person with disability", "person with disability since the childhood", "child with disability" and "person with disability owing to war" in the corresponding case and number.

3. In the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 29, Art. 399 with subsequent changes):

1) in the text of Article 28 of the word "disabled person", to "it" and "it" to replace respectively with words "person with disability", "it" and "it";

Orphan children have pension entitlement in case of loss of the supporter before achievement of 23 years by them irrespective of, they study or not";

3) in Article 54:

state the name in the following edition:

"Article 54. Pension payment to the working pensioners";

in parts one of figure and the word "December 31" to replace with figures and the word "September 30";

the second to state part in the following edition:

"Since October 1, 2017 pensions are paid without the received salary (income)";

third to exclude part;

To replace 4) in the text of the Law of the word "disabled person", "disabled person since the childhood", "handicapped child" and "disabled veteran" in all cases and numbers respectively with the words "person with disability", "person with disability since the childhood", "child with disability" and "person with disability owing to war" in the corresponding case and number.

4. Article 8 of the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383; 2009, No. 13, Art. 161; 2011, No. 5, Art. 29; 2013, No. 21, Art. 208, No. 33, Art. 436; 2014, Art. No. 20-21, 712, No. 50-51, Art. 2057; 2016, 30, the Art. 542) to add No. with part fourteen of the following content:

"Certificates of the amount of notarized agreements which are necessary only for check of compliance with law concerning payment of collection on compulsory national pension insurance are provided by the notary within 10 working days according to the reasonable written request of bodies of the Pension fund of Ukraine".

5. In article 37 of the Law of Ukraine "About public service" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 52, Art. 490; 2012, No. 12-13, of Art. 82; 2015, No. 6, Art. 40, No. 22, Art. 145; 2016, No. 5, Art. 50; 2017, No. 2, Art. 25):

in part four:

in paragraph one of figure and the word "December 31" to replace with figures and the word "September 30";

in paragraphs second and third words and figures of "disabled people of I and II groups, disabled veterans" shall be replaced with words also in figures "persons with disability of I and II groups, persons with disability owing to war";

the fifth to state part in the following edition:

"Since October 1, 2017 the pensions granted after entry into force of the Law of Ukraine "About measures of rather legislative ensuring reforming of the pension system" (except persons with disability of I and II groups, persons with disability owing to war of III group and combatants, persons on whom action of Item 1 of article 10 of the Law of Ukraine "Expatiates on the status of veterans of war of guarantee of their social protection") according to this Article, during work on the positions of public service determined by the Law of Ukraine of December 10, 2015 No. 889-VIII "About public service" and also on positions and on the conditions provided by the laws of Ukraine "About prosecutor's office" "About judicial system and the status of judges", are paid in the amount of, estimated according to the Law of Ukraine "About obligatory national pension insurance".

In the second offer of part two of article 18 of the Law of Ukraine "About judicial examination" (Sheets of the Verkhovna Rada of Ukraine, 1994, No. 28, Art. 232; 2005, No. 1, Art. 14; 2015, No. 22, Art. 145; 2016, No. 5, Art. 50; 2017, No. 2, the Art. 25) figures and the word "December 31" to replace with figures and the word "September 30", and words and figures of "disabled people of I and II groups, disabled veterans" - words and figures "persons with disability of I and II groups, persons with disability owing to war".

7. In the Law of Ukraine "About collection on compulsory national pension insurance" (Sheets of the Verkhovna Rada of Ukraine, 1997, No. 37, Art. 237 with subsequent changes):

1) in Article 1 part one:

in Item 7 the word of "disabled people" shall be replaced with words "persons with disability";

add Item 9 with paragraphs third - the sixth the following content:

"The notarial certificate of purchase and sale agreements of real estate is performed in the presence of documentary payment confirmation of collection on compulsory national pension insurance from transactions of purchase and sale of real estate.

The collection amounts on compulsory national pension insurance from transactions of purchase and sale of real estate are paid by payers of this collection in the location of office of notary public or workplace of the private notary.

Notaries quarterly, to the 20th following reporting quarter represent to bodies of the Pension fund of Ukraine for the location of office of notary public or workplace of the private notary the report on the signed purchase and sale agreements of real estate, including information on the cost of such property and the amount of the fee paid on compulsory national pension insurance according to the procedure and in form, determined by the Cabinet of Ministers of Ukraine.

Information from the State register of the corporeal rights to real estate on request of the Pension fund of Ukraine and its territorial authorities, other public authorities, local government bodies, courts, law-enforcement bodies, bodies of prosecutor's office, bodies of Security service, notaries, lawyers is provided according to the procedure, approved by the Cabinet of Ministers of Ukraine";

The paragraph the fourth Item 1 of Article 2 to state 2) in the following edition:

"For the payers of collection determined by Items 1 and 2 of part one of article 1 of this Law except the payers carried to the fourth group of the payers of the single tax determined by the subitem 4 of Item 291.4 of article 291 of the Tax Code of Ukraine, the taxation object are also actual expenses on payment and delivery of the pensions granted about day of entry into force of the Law of Ukraine "About modification of some legal acts of Ukraine concerning increase in pensions" according to the Items - "з" article 13 of the Law of Ukraine "About provision of pensions" and appointed after day of entry into force of the specified Law according to Items 2 - 8 parts two of article 114 of the Law of Ukraine "About obligatory national pension insurance" before achievement of retirement age by workers, the stipulated in Article 26 Laws of Ukraine "About obligatory national pension insurance".
