About modification of the Procedure for realization of distrained property

According to part two of article 61 of the Law of Ukraine "About enforcement proceeding" I order:

1. Bring in the Procedure for realization of distrained property approved by the order of the Ministry of Justice of Ukraine of September 29, 2016 No. 2831/5, registered in the Ministry of Justice of Ukraine on September 30, 2016 at No. 1301/29431, the following changes:

The paragraph of the seventh of Item 5 of the Section II to state 1) in the following edition:

"If the personal estate is subject to realization, such property is transferred to storage to the Organizer no later than day of the direction by department of the public executive service, the private contractor of the request for realization of this property.";

2) to add Item 2 of the Section VII with the new paragraph of the following content:

"If the electronic biddings on realization of subject of mortgage are announced not taken place, the act of realization of subject of mortgage (in case of acquisition by the mortgage holder of subject of mortgage at the initial price by offsetting of the secure requirements on account of the property price) is issued based on the protocol created by results of the electronic biddings which did not take place".

2. To department concerning justice and homeland security of the Ministry of Justice of Ukraine (Oleynik A. N.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the deputy minister of justice of Ukraine concerning executive service Shklyar S. V.
