About introduction of amendments to the Tax Code of Ukraine concerning stabilization of calculations in the wholesale market of electrical energy of Ukraine

The Verkhovna Rada of Ukraine decides:

I. Bring in the Tax code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2011, Art. No. No. 13-17, 112) the following changes:

1. To add Item 120-1.1 of Article 120-1 after the paragraph of the fifth with the new paragraph of the following content:

"50 percent of the tax amount on value added specified in such tax delivery notes / calculations of adjustment - in case of violation of term of registration on 366 and more calendar days".

With respect thereto to consider paragraphs of the sixth and seventh respectively paragraphs the seventh and eighth.

2. In paragraphs four and the fifth Item 198.6 of Article 198:

replace figures "365" with figures "1095";

the second offer to exclude.

3. The eighteenth Item 201.10 of Article 201 to state the paragraph in the following edition:

"The taxpayer has the right to register in the Unified register of tax delivery notes the tax delivery note and/or calculation of adjustment constituted since July 1, 2015 in which the total amount of tax does not exceed the amount estimated according to Item 200-1.3 of Article 200-1 - of this Code".

4. To add subsection 2 of the Section XX "Transitional provisions" with Item 62 following of content:

"62. Temporarily, till July 1, 2018, penalties, are not applied by stipulated in Article 120-1, article 126 of this Code (regarding the value added tax), and the penalty fee established by subitem 129.1.3 of Item 129.1 of article 129 of this Code (regarding the value added tax), to electric power producers who perform delivery of electrical energy to the state company "Energorynok" is not charged and as of January 1, 2016 had the tax debt on the value added tax including spread and/or delayed.
