About drugs, psychotropic substances, precursors and counteraction to their illicit trafficking

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) drugs – substances of synthetic or natural origin, their medicines, including medicinal, and also the plants included in the List of the drugs, psychotropic substances and precursors which are subject to control according to the legislation of Turkmenistan, international treaties of Turkmenistan, including the Single convention of the UN on drugs of 1961 with the amendments made to it according to the Protocol of 1972 on amendments to the Single convention of the UN on drugs of 1961;

2) psychotropic substances – substances of synthetic or natural origin, their medicines, including the medicinal, and also natural materials included in the List of the drugs, psychotropic substances and precursors which are subject to control according to the legislation of Turkmenistan, international treaties of Turkmenistan, including the Convention of the UN on psychotropic substances of 1971;

3) precursors of drugs and psychotropic substances (further – precursors) – the substances used in case of production, production, conversion of drugs and psychotropic substances, included in the List of the drugs, psychotropic substances and precursors which are subject to control according to the legislation of Turkmenistan, international treaties of Turkmenistan, including the Convention of the UN on fight against illicit trafficking in drugs and psychotropic substances of 1988;

4) analogs of drugs and psychotropic substances – the substances of synthetic or natural origin prohibited for turnover in Turkmenistan not included in the List of the drugs, psychotropic substances and precursors which are subject to control in Turkmenistan, on chemical structure and properties similar to drugs and psychotropic substances, causing similar psychoactive action;

5) the medicine containing drugs, psychotropic substances or precursors (further – medicine) – the mix of substances in any physical condition containing one or several drugs, the psychotropic substances or precursors deposited in the List of drugs, the psychotropic substances and precursors which are subject to control in Turkyomenistan;

6) drug trafficking, psychotropic substances and precursors – the types of activity permitted and controlled according to the legislation of Turkmenistan connected with cultivation, collection and procurement of narkotikosoderzhashchy plants, development, production, production, conversion, storage, leave, realization, distribution, acquisition, use, transportation, transfer, import, export, transit and destruction of drugs, psychotropic substances and precursors;

7) drug trafficking, psychotropic substances and precursors – the drug trafficking performed in violation of the law of Turkmenistan, psychotropic substances and precursors;

8) import and export of drugs, psychotropic substances and precursors – movement of drugs, psychotropic substances and precursors from one state to other state;

9) production of drugs, psychotropic substances and precursors – all processes, except for productions by means of which drugs, psychotropic substances and precursors, and also transformation of drugs, psychotropic substances and precursors in other drugs, psychotropic substances and precursors can be received;

10) production of drugs, psychotropic substances and precursors – the process directed to serial receipt of drugs, psychotropic substances and precursors from chemicals and (or) plants or from other drugs, psychotropic substances and precursors;

11) conversion of drugs, psychotropic substances and precursors – actions from which result refinement (cleaning of foreign impurity), increase in medicine of concentration of drugs, psychotropic substances and precursors, and also obtaining on their basis of the substances which are not drugs, psychotropic substances and precursors;

12) use of drugs, psychotropic substances and precursors – target use of drugs, psychotropic substances and precursors;

13) transportation and transfer of drugs, psychotropic substances and precursors – any actions for movement of drugs, psychotropic substances and precursors irrespective of method of transportation and the storage location;

14) cultivation of the plants containing narcotic substances – crops and cultivation of the narkotikosoderzhashchy plants included in the List of the drugs, psychotropic substances and precursors which are subject to control in Turkmenistan according to international conventions;

15) collection of the plants containing drugs, psychotropic substances – collecting of the wild-growing or cultivated narkotikosoderzhashchy plants included in the List according to international conventions;

16) transit of drugs, psychotropic substances and precursors – movement of drugs, psychotropic substances and precursors from one state to other state through the territory of the third state;

17) drug addiction – the disease caused by physical and (or) mental dependence on any drug, psychotropic substance or their analogs, leading to heavy violations of physical and mental functions of human body;

18) sick drug addiction – person which is in condition of physical and (or) mental dependence on any drug, psychotropic substance or their analogs and to which the relevant medical institution makes the diagnosis - "drug addiction";

19) illegal consumption of drugs or psychotropic substances – consumption of drugs or psychotropic substances without appointment of the doctor;

20) voluntary treatment – the treatment for drug addiction, toxicomania or abuse of drugs and other stupefying substances performed with the consent of the patient or his legal representative;
