About modification of Bases of the legislation of Ukraine on health care of rather single questions of protection of the rights of citizens in the field of health protection

The Verkhovna Rada of Ukraine decides:

I. Bring in bases of the legislation of Ukraine on health care (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 4, the Art. 19) the following changes:

1. To state the Item "y" of part one of Article 6 in the following edition:

"й) possibility of conducting independent medical examination of the corresponding type in case of the citizen's disagreement with the conclusions of the state medical examination, application of measure of restraint to it as to person concerning whom application of enforcement powers of medical nature is supposed or the issue of their application, enforcement powers of medical nature, forced treatment, forced hospitalization and in other cases when actions of workers of health care violate the rights of the citizen of Ukraine to health protection was resolved".

2. The second Article 9 to state part in the following edition:

"Application of measures of restraint to person concerning whom application of enforcement powers of medical nature is supposed or the issue of their application was resolved, enforcement powers of medical nature concerning persons who made socially dangerous acts of forced treatment to persons who committed crimes and have disease which constitutes health hazard of other persons, restriction of the rights of other citizens in the form of forced treatment, forced hospitalization or in connection with establishment of quarantine are allowed only on the bases and according to the procedure, provided by the law".

II. Final provisions

1. This Law becomes effective from the date of, its publication following behind day, and becomes effective in three months from the date of entry into force.

2. To the Cabinet of Ministers of Ukraine within three months from the date of publication of this Law:

adopt the regulatory legal acts following from this Law;

bring the regulatory legal acts into accord with this Law;
