About modification of the order of the Government of the Kyrgyz Republic "About approval of Rules about procedure for application of procedures of process of bankruptcy" of December 30, 1998 No. 865

For the purpose of reduction of the decision of the Government of the Kyrgyz Republic in compliance with the Law of the Kyrgyz Republic "About bankruptcy (insolvency)", being guided by articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About approval of Rules about procedure for application of procedures of process of bankruptcy" of December 30, 1998 No. 865 the following changes:

in Rules about procedure for application of the procedures of process of bankruptcy approved by the above-stated resolution:

- Section 3.15. add with Item 3.15.6. following content:

"3.15.6. Based on the written request of the creditor the administrator shall report about the course of implementation of insolvency proceeding and financial condition of the debtor no later than ten working days from the moment of receipt of such request.";

- Section 4.17. add with Item 4.17.2-1. following content:

"4.17.2-1. Creditor meeting has the right to agree to the external managing director to obtaining unsecured pledge of the credits for implementation of economic activity and the plan of rehabilitation of the debtor.

If the external managing director could not obtain unsecured pledge the credit, the court in case of the consent of creditor meeting issues permission to the external managing director on receipt of secured loan of property of the debtor which is not pledge subject.";
