About approval of changes in some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 15, of 40, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of reduction of regulatory legal acts of the National Bank of Ukraine according to the legislation of Ukraine the Board of the National Bank of Ukraine decides:

1. Approve Changes in the Instruction about procedure for opening, use and closing of accounts in national and foreign currencies, approved by the resolution of Board of the National Bank of Ukraine of November 12, 2003 No. 492, registered in the Ministry of Justice of Ukraine on December 17, 2003 for No. 1172/8493 (with changes) which are applied.

2. Bring in the Instruction about clearing settlements in Ukraine in the national currency approved by the resolution of Board of the National Bank of Ukraine of January 21, 2004 No. 22, registered in the Ministry of Justice of Ukraine on March 29, 2004 for No. 377/8976 (with changes), such changes:

Paragraph two of Item 1.6 of Chapter 1 to state 1) in the following edition:

"The bank has no right to determine and control the directions of use of money of the client and to set other restrictions of its right on the order with money which are not provided by the law, the contract between bank and the client or conditions of encumbrance which subject are property rights on the money placed on the bank account.";

Item 2.22 of Chapter 2 to state 2) in the following edition:

"2.22. The bank carries out settlement documents according to priority of their receipt according to Article 1072 of the Civil code of Ukraine and is exclusive within balance on the customer account if other is not established by the contract between bank and the client.";
