About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – Article 25 of the Law on the Supreme council of magistracy No. 947/1996 (repeated publication: 2013, 65), with subsequent changes and amendments to state the official monitor of the Republic of Moldova to Art. No. 15-17, in the following edition:

"Article 25. Appeal of decisions of the Supreme council of magistracy

(1) Decisions of the Supreme council of magistracy can be appealed in the Highest trial chamber only in the part concerning the procedure of edition/acceptance, any interested person within 15 days from the date of their message.

(2) Claims are considered by structure of court from five judges.

(3) the Decisions of the Highest trial chamber made according to requirements of part (2), are final and become effective from the date of acceptance.".

Art. II. – Article 40 of the Law on disciplinary responsibility of judges No. 178/2014 (2014, 557), with subsequent changes and amendments, to state the official monitor of the Republic of Moldova to Art. No. 238-246, in the following edition:

"Article 40. Appeal of decisions of the Supreme council of magistracy

(1) the Decisions of the Supreme council of magistracy made according to requirements of Article 39, can be appealed in the Highest trial chamber only in the part concerning the procedure of edition/acceptance, person who submitted the application, judicial inspection or the judge concerning whom the decision, in 15-day time from the date of receipt of the motivated decision is passed.

(2) Applications for appeal are considered by the structure created according to requirements of part (2) article 25 of the Law on the Supreme council of magistracy No. 947/1996. The term of consideration shall not exceed 30 days.".
