About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes and amendments to make the following changes and additions:
1. In part (2) Article 229-2 of the word "181-2, 239-240, 242-1-243, 279, 324-329, 330-1, 330-2, 332 - 335-1 and 352-1" shall be replaced with words "141, 144, 158, 164, 165, 165-1, 166-1, 167, 168, 181-2, 206, 217-1, 217-3, 218, 220, 239–240, 242-1 – 244, 248, 249, 259, 260, 260-2 – 260-4, 260-6, 279, 283–284, 324–329, 330-1, 330-2, 332 – 335-1 and 352-1".
2. State Article 229-3 in the following edition:
"Article 229-3. Establishment of prohibition on the order the property got in the criminal way
On the revealed property got in the criminal way the prohibition on the order by determination of degree of jurisdiction about property attachment or, on circumstances, the warrant for freezing issued according to the Law on the Agency on compensation of the property No. 48/2017 got in the criminal way is established.".
3. Part (Article 229-5 to add 1) with words: ", and in case of their absence, carries over on a grant basis the state.".
4. Add Article 229-7 with part (1-1) following contents:
"(1-1) V departure from part provisions (1) this Article use according to Article 207-1 of the property got in the criminal way provided in part (2) Article 229-2, it is provided with Agency on compensation of the property got in the criminal way according to the law and the provision approved by the Government.".
