About entering of amendments into the Code of television and radio of the Republic of Moldova No. 260/2006

The Parliament adopts this organic law.

Art. I. – In the Code of television and radio of the Republic of Moldova No. 260/2006 (Official monitor of the Republic of Moldova, 2006, Art. No. 131-133, 679), with subsequent changes and amendments, to make the following additions:

1. Add Article 2 with the Item z-5) of the following content:

"z-5) information security – the protected condition of information resources, persons, societies and the states, including package of measures for ensuring protection of persons, societies and the states from possible attempts of misinformation and/or information manipulation from the outside and non-admissions of the provocations of media nature directed against the Republic of Moldova.".

2. Part (1) articles 7 after word "pluralism", to add with the words "information security".

3. Add Article 9 with part (2-1) following of content:

"(2-1) For the purpose of ensuring information security of the state to resolve the broadcasting organizations and distributors of programs broadcast of TV schedules and radio with information, information and analytical, military and political content which are made in member states of the European Union, the USA, Canada, and also in the states which ratified the European convention on cross-border television.".

4. Part (Article 27 to add 1) with Item i) the following content:

"i) does not observe part provision (2-1) Articles 9.".

5. Add Article 38 with parts (6-1) and (12-1) following contents:

"(6-1) Penalty in the amount of 40000 to 70000 lei are imposed on the broadcasting organizations and distributors of the programs which broke part provisions (2-1) Articles 9. For repeated making of violations of these provisions the penalty will constitute from 70000 to 100000 lei. Revocation of license on broadcasting for violation of provisions of part (2-1) Articles 9 are applied only after consecutive application of the sanctions provided by this part.";
