About modification of the Order of the Government of the Russian Federation of January 26, 2017 No. 89

The government of the Russian Federation decides:

Approve the enclosed changes which are made to the order of the Government of the Russian Federation of January 26, 2017 No. 89 "About the register of non-profit organizations - contractors of socially useful services" (The Russian Federation Code, 2017, No. 6, Art. 937; No. 39, Art. 5710).

Changes which are made to the Order of the Government of the Russian Federation of January 26, 2017 No. 89

1. In Rules of decision making about recognition of socially oriented non-profit organization by the contractor of the socially useful services approved by the specified resolution:

a) state Item 2 in the following edition:

"2. Decisions on recognition of the organizations by contractors of socially useful services are made by the Ministry of Justice of the Russian Federation and its territorial authorities (further - authorized body).

The Ministry of Justice of the Russian Federation makes decisions on recognition by contractors of socially useful services of the all-Russian public organizations and movements, Chamber of Commerce and Industry of the Russian Federation and Chambers of Commerce and Industry created in the territory of several subjects of the Russian Federation, the centralized religious organizations having the local religious organizations in the territory of 2 and more subjects of the Russian Federation and also the religious organizations formed by the specified centralized religious organizations.

Territorial authorities of the Ministry of Justice of the Russian Federation make decisions on recognition by contractors of socially useful services of interregional, regional and local public organizations and movements, regional departments of the international, all-Russian and interregional public organizations and movements, the local religious organizations, the centralized religious organizations having the local religious organizations in the territory of one subject of the Russian Federation, the religious organizations formed by the specified centralized religious organizations and also other non-profit organizations to which the special procedure for state registration of non-profit organizations established by the Federal Law "About Non-profit Organizations" extends.";

b) in paragraph one of Item 3 of the word "Ministry of Justice of the Russian Federation" shall be replaced with words "authorized body";

c) add with Item 3 (1) the following content:

"3(1). For additional entering into the register of data on the socially useful services rendered by the organization which is earlier included in the register, such organization submits the following documents to authorized body:

a) the statement for additional entering into the register of data on the socially useful services rendered by the organization which is earlier included in the register for form according to appendix No. 4;

b) the conclusion in form according to appendix No. 2.";

d) items 4 - 6 to state in the following edition:

"4. The documents specified in Items 3, of 3(1) and 11 these rules can be directed by the mailing with the inventory of investment, are provided directly, directed in the form of the electronic documents signed by the digital signature with use of information and telecommunication networks public, including the Internet, including the federal state information system "Single Portal of the State and Municipal Services (Functions)". Different ways of submission of the specified documents are determined by the Ministry of Justice of the Russian Federation.

The documents specified in Items 3, of 3(1) and 11 these rules, which arrived in body to which competence decision making about recognition of the organization by the contractor of socially useful services according to Item 2 of these rules is not referred go within 5 working days from the date of their receipt to authorized body with the notification of the organization on readdress of documents.

5. The conclusion is issued to the organization by federal executive bodies (their territorial authorities) and the executive bodies of subjects of the Russian Federation performing quality evaluation of rendering socially useful services according to the list according to appendix No. 3 (further - the interested bodies) based on the statement of the organization for issue of the conclusion constituted in writing in which compliance of the services rendered by the organization to the established quality criterions of rendering socially useful services locates. The list of the data which are subject to inclusion in the statement of the organization for issue of the conclusion is determined in the administrative regulations establishing procedure for provision of the state service in quality evaluation of rendering socially useful services.

The documents proving compliance of the services rendered by the organization to the established quality criterions of rendering socially useful services (references, characteristics, expert opinions, the conclusions of public councils can be enclosed to the specified application under the interested bodies and others), and also the documents confirming lack of the tax debts and to charges, others to stipulated by the legislation obligatory payments of the Russian Federation.

Names of socially useful services are specified in the statement according to the list of socially useful services approved by the order of the Government of the Russian Federation of October 27, 2016 No. 1096 "About approval of the list of socially useful services and quality criterions of their rendering".

The statement of the organization for issue of the conclusion and documents attached to it can be directed by the mailing with the inventory of investment, are provided directly, directed in the form of the electronic documents signed by the digital signature with use of information and telecommunication networks public, including the Internet, including the federal state information system "Single Portal of the State and Municipal Services (Functions)". Different ways of submission of the specified statement are determined by the interested bodies.

If the organization is included in the register of suppliers of social services in the corresponding socially useful service, submission of the additional documents proving compliance of the services rendered by the organization to the established quality criterions of rendering socially useful services it is not required.

6. The quality evaluation of rendering socially useful services is performed by federal executive body according to its competence of the relation of the socially oriented non-profit organization which is rendering one socially useful service in the territory of more than a half of subjects of the Russian Federation and (or) got financial support at the expense of means of the federal budget in connection with rendering socially useful services by it. The quality evaluation of rendering socially useful services is performed by territorial authorities of federal executive bodies and executive bodies of subjects of the Russian Federation according to their competence of the relation of other socially oriented non-profit organizations.

If the quality evaluation of rendering socially useful service is performed by several interested bodies, the conclusion is issued by the interested body in which the statement for issue of the conclusion arrived. The interested body in which the statement for issue of the conclusion arrived if necessary requests from other interested bodies, and also other public authorities of the data according to the procedure of interdepartmental information exchange. The term of the response to interdepartmental request cannot exceed 15 working days from the date of receipt of interdepartmental request in the specified bodies.

In case of receipt of the statement for issue of the conclusion in body to which competence the quality evaluation of rendering specific socially useful service is not carried the specified body within 5 working days from the date of receipt directs applications it on accessory to the interested body performing quality evaluation of rendering this socially useful service provided by appendix No. 3 to these rules.

The documents confirming absence at the organization of the tax debts and to charges, others to stipulated by the legislation obligatory payments of the Russian Federation are represented to the interested body by tax authorities according to the procedure of interdepartmental information exchange on its request.";

e) add Item 7 with the subitem "zh" of the following content:
