The government of the Republic of Kazakhstan DECIDES:

1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:

1) ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 25.08.2018 No. 522

2) in the order of the Government of the Republic of Kazakhstan of April 19, 2016 No. 234 "About some measures of the state support of private entrepreneurship" (SAPP of the Republic of Kazakhstan 2016, Art. No. 25-26, 139):

2) and 3) of Item 1 to state subitems in the following edition:

"2) Rules of guaranteeing on the credits of subjects of small and medium entrepreneurship within the Single program of support and business development "The road map of business of 2020";

3) Rules of provision of state grants to small business entities for realization of the new business ideas and industrial and innovative projects within business incubation within the Single program of support and business development "The road map of business of 2020".";

in Rules of subsidizing of part of rate of remuneration within the Single program of support and business development "The road map of business of 2020" approved by the specified resolution:

in Item 6:

12) to state the subitem in the following edition:

The credits of subjects of small and medium entrepreneurship issued (issued) by banks at the expense of funds of ENPF for replenishment of current assets and (or) refinancing of the current obligations are also subject to subsidizing.

Subsidizing of rate of remuneration on the credits of banks including issued at the expense of means of ENPF, directed to replenishment of current assets to operating plants is also performed within the limits allocated from republican and local budgets. On the credits directed to replenishment of current assets, and also refinancing of the current obligations are not required increase in annual average number of workplaces, on the basis of data on compulsory pension contributions and (or) social assignments and growth of the income for 10% of the corresponding indicators after project implementation.";

"16. The entrepreneur under credits/agreements of financial leasing over 180 million tenges shall provide participation in project implementation of own means (money, personal/real estate), including the property of the third parties provided in providing at the level of not lower than 10% of total cost of project implementation. Conditions of participation of the entrepreneur in the project own means (cash means / personal/real estate) are reflected in the solution of RKS.

17. In case of provision of ensuring obligation fulfillment under the credit/agreement of financial leasing by the personal/real estate which is directly not participating in project implementation, this property is not considered as own participation in the project.

18. At the same time under credits/agreements of financial leasing which amount does not exceed 180 million tenges own participation in project implementation is not required.";

"20. Subsidizing term under the credits/agreements of financial leasing directed to investments constitutes 5 (five) years without the right of prolongation of term of subsidizing. The term of subsidizing of the credits allocated for replenishment of current assets constitutes 3 (three) years without the right of prolongation of term of subsidizing. If on one project several agreements of subsidizing are signed, aggregate term of subsidizing is established from the moment of signing of the first agreement of subsidizing by the financial agency.

On the projects approved till January 1, 2018 with subsidizing term three years prolongation for additional two years (aggregate term of subsidizing - no more than five years is possible from the moment of signing of the first agreement of subsidizing on the project) on the conditions operating for date of approval of prolongation of RKS.

Prolongation of the duration of the agreement of subsidizing after 3 (three) years is performed based on the petition of bank/bank of the development / leasing company given for consideration of RKS in 60 calendar days prior to subsidizing expiration of the contract only in the presence of means for subsidizing from the republican budget at the time of approval of RKS.

The solution of RKS on prolongation / not prolongations of the current agreement of subsidizing shall be accepted in 45 calendar days prior to subsidizing expiration of the contract. At the same time the financial agency provides signing of the supplementary agreement to the agreement of subsidizing by bank/bank of development / the leasing company / entrepreneur before expiration of the current agreement of subsidizing, in case of acceptance of RKS of the positive decision on prolongation of the current agreement of subsidizing.";

state Item 24 in the following edition:

"24. Subsidizing is performed is paid only for credits/contracts of financial leasing with the nominal rate of remuneration which is not exceeding the base rate of remuneration established by National Bank of the Republic of Kazakhstan and increased by 5 (five) percent points from which 50% of nominal rate will be subsidized with the state and difference by the entrepreneur.";

New effective investment projects, and also the projects directed to upgrade and expansion of production are understood as projects:

1) subjects of medium business, reached growth of the income for 20% the previous 3 (three) years prior to filing of application by the entrepreneur to the regional coordinator of the Program / to the financial agency;

2) small business entities, the providing growth of the income, increase in annual average number of workplaces, on the basis of data on compulsory pension contributions and (or) social assignments for 10% after 2 (two) financial years from the date of the solution of RKS / the financial agency.

The credits of subjects of small and medium entrepreneurship issued (issued) by banks at the expense of funds of ENPF for replenishment of current assets and (or) refinancing of the current obligations within the projects realized in priority sectors of economy within the Program, the industries of processing industry and separate types of service determined by GPIIR and without industry restrictions are also subject to subsidizing.

Subsidizing of rate of remuneration on the credits of banks including issued at the expense of means of ENPF, directed to replenishment of current assets to operating plants is also performed within the limits allocated from the republican and local budget. On the credits of subjects of private entrepreneurship directed to replenishment of current assets, and also the refinancing of the current obligations, requirements provided in part two of this Item do not extend.";

"40. The amount of the credit/agreement of financial leasing under which subsidizing of part of rate of remuneration is performed cannot exceed 2, 5 billion tenges for one entrepreneur and is calculated without debt on the credit/agreement of financial leasing of the persons/companies, affiliirovanny with it.

The credits of entrepreneurs in case of partial/complete early repayment of principal debt on the subsidized credit within the limits set by the Program are allowed to subsidizing.

41. Subsidizing term under the credits/agreements of financial leasing directed to investments constitutes 5 (five) years without the right of prolongation of term of subsidizing. The term of subsidizing of the credits allocated for replenishment of current assets constitutes 3 (three) years without the right of prolongation of term of subsidizing. 46. Subsidizing on the projects realized in the priority industries of processing industry determined by GPIIR is performed only under credits/contracts of financial leasing with the nominal rate of remuneration which is not exceeding the base rate of remuneration established by National Bank of the Republic of Kazakhstan and the difference increased by 5 (five) percent points from which 50% of nominal rate are compensated by the state and is paid by the entrepreneur.";

At the same time 50% of newly created workplaces are recommended to be created for the youth up to 29 years registered in jobcenters of the population.

Limiting date of creation of new permanent workplaces is reflected in the solution of RKS.

56. Subsidizing term under the credits/agreements of financial leasing directed to investments constitutes 5 (five) years without the right of prolongation of term of subsidizing. The term of subsidizing of the credits allocated for replenishment of current assets constitutes 3 (three) years without the right of prolongation of term of subsidizing. If on one project several agreements of subsidizing are signed, aggregate term of subsidizing is established from the moment of signing of the first agreement of subsidizing by the financial agency.

68. 2) the business plan of project implementation of the entrepreneur containing under credits/agreements of financial leasing over 180 million tenges terms of ensuring participation in project implementation of own means (money, personal/real estate), including the property of the third parties provided in providing at the level of not lower than 10% of total cost of project implementation, and also in case of filing of application on participation within the first direction of the Program for projects of entrepreneurs/small business entities within the second direction of the Program - stages on achievement of growth of the income and increase in annual average number of workplaces on the basis of data on compulsory pension contributions and (or) social assignments for 10% after 2 (two) financial years from the date of the solution of RKS / authorized body of the financial agency;
