About modification of the Regulations on data sets which are subject to promulgation in the form of open data

The Cabinet of Ministers of Ukraine decides:

Bring in Regulations on data sets which are subject to promulgation in the form of open data, approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 2015 No. 835 (The Official Bulletin of Ukraine, 2015, No. 85, Art. 2850; 2017, No. 44, the Art. 1368), changes which are applied.

Changes which are made to Regulations on data sets which are subject to promulgation in the form of open data

1. Add Item 1 with paragraphs of the following content:

"Promulgation of data sets in the form of open data is performed by the following principles:

openness by default;

efficiency and clearness;

availability and use;

comparability and interoperability;

the improved management and involvement of citizens;

inclusive development and innovations.".

2. State Item 2 in the following edition:

"2. The terms used in this Provision have such value:

open format - format of data which does not depend on platform and is available without restrictions which interfere with its reuse;

the application programming interface (server-side Web API) - set of ready functions provided in the form of service for use in external applications for ensuring dynamic access to data sets;

machine-readable format - the format of data structured in such a way that gives the chance to information systems to identify, distinguish, transform and obtain specific data without participation of the person;

metadata - the structured reference information which describes explains, gives the chance to identify, simplifies use and management of data set;

data set - set of homogeneous values (records) of the data and metadata describing them;

promulgation of data set - placement of information of data set by the manager on the Internet and ensuring access to it;

the passport of data set - the set of metadata containing the description of data set, necessary for its identification and use;

structure of data set - the set of metadata containing the description of structure (elements) of data set, their format, parameters and appointment.

Creation and ensuring functioning of the Single state web portal of open data is performed by the State agency concerning electronic control which is his holder.

Administrator of the Single state web portal of open data is the state company which belongs to the sphere of management of the State agency concerning electronic control.".

3. In Item 3 of the word "and also" to replace with the word "and".

4. State Items 4-6 in the following edition:

"4. Data sets are published and regularly updated by the manager of information on the Single state web portal of open data.

In case of modification of the list of the data sets which are subject to promulgation in the form of open data the manager of information in three-months time from the effective date of such changes performs their promulgation and further updating on the Single state web portal of open data.

5. For ensuring access to public information the manager of information:

can perform promulgation of data sets which are not included in the list if other is not provided by the Law of Ukraine "About access to public information", in case of high public interest in such data (high frequency of their requests; on survey results of public opinion; availability of other circumstances);

publishes and regularly updates the data sets which are in its ownership on the Single state web portal of open data.

6. On the page of each data set on the Single state web portal of open data takes place:

the passport of data set by display on the web page (for viewing by means of the web browser) and by placement of the file in open machine-readable format which can be loaded or available by means of the application programming interface;

structure of data set in open machine-readable format (the electronic file which can be loaded, or the application programming interface);

data set in one or several formats determined by this Provision;

form for feedback of users;

information on further use of data set;

information on conditions of use of the open license.".

5. In Item 7:

after the paragraph of the fourth to add Item with the new paragraph of such content:

"the basis and purpose of information collection, containing in data set;".

"Geospatial data GeoTIFF, SHP, DMF, MID/MIF, DXF, HML, GeoJSON, GPX, LOC, ARINC, AIXM.".

8. To state paragraph two of Item 10 in the following edition:

"Requirements to the application programming interface are determined by the holder of the Single state web portal of open data.".

9. Exclude Item 12.

10. Add Item 14 with the paragraph of the following content:

"Shall precede the temporary termination of provision of access to the published data sets by means of the application programming interface for scheduled maintenance the corresponding prevention on the homepage of the Single state web portal of open data at least in 24 hours prior to such suspension.".

11. State Item 15 in the following edition:

"15. The manager of information independently determines frequency of updating of data sets which are in its ownership and will be promulgated if other is not stipulated by the legislation.

Such frequency of updating of data sets can be established:

for the data sets promulgated by means of the application programming interface - right after modification;

for the data sets having planned frequency of updating: more than once a day; daily; weekly; monthly; quarterly; every half-year; annually;

for data sets, changes in which were made off-schedule - within three working days from the moment of introduction of such changes.".
