About modification of some legal acts of Ukraine concerning ensuring boundary safety of the state

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Verkhovna Rada of USSR, 1984, Appendix to No. 51, the Art. 1122):

1) in Article 38:

in part two of the word "specified in part three" shall be replaced with words "specified in parts three and the fourth";

after part three to add with new part of the following content:

"Administrative punishment for making of the offenses provided by Articles 204-1 and 204-2 of this Code can be imposed within three months from the date of their detection, but no later than year from the date of their making, and in case of making of such offenses by foreigners or stateless persons on which in the procedure established by the law the decision on forced return or exclusion from Ukraine - during the time necessary for their departure from Ukraine is made, but no later than the term determined by the law for departure of these persons from Ukraine or ensuring their exclusion from Ukraine".

With respect thereto the fourth to consider part part five;

2) in Article 185-10:

state part one in the following edition:

"Malicious disobedience to the legal order or the requirement of the serviceman or employee of the State Border Service of Ukraine in case of execution of the service duties connected with protection of frontier, the sovereign rights of Ukraine in its exclusive (sea) economic zone or implementation of border control at check points (control Items) through frontier of Ukraine or checkpoints of entrance departure, or the member of public forming on protection of public order and frontier who participates in protection of frontier of Ukraine by it,

attracts imposing of penalty from fifty to hundred free minima income of citizens or corrective works for a period of one up to two months with assignment of twenty percent of earnings, or administrative detention for a period of up to fifteen days";
