About target use of the nature protection tax paid by the companies

Article 1. Provision of assignments to the communities subjected to impact from the ecological tax paid to the companies for the purpose of implementation of nature protection programs

1. Assignments from the nature protection tax paid by the companies having the right to subsurface use for the purpose of production of metal minerals in the Republic of Armenia, and also other companies included in the list constituted by authorized body in the field of the environment are made and reflected separately in the budget of community in which administrative borders there are air, water or land territories on which activities of the specified companies make harmful effects. The list of other companies specified in this part annually constitutes authorized body in the field of the environment based on the criteria established by the Government.

2. The list of communities and the sizes of the amounts deducted in their administrative and share budgets affirm for every year the law on the government budget for this year. Assignments within the next fiscal year are made directly from the government budget in the form of subvention. The amount of assignments is determined, proceeding from the total amount of the nature protection tax calculated by the relevant companies specified in this Article by single tax calculations of nature protection tax and payments for environmental management by results of the second, third and fourth preceding the forthcoming fiscal year, reducing it in the amount of the total amount of assignments provided by the government budget for the corresponding communities for the first year preceding the forthcoming fiscal year, and actually provided community for the second year. Creation of the list of communities or settlements and calculation of the amount of distribution of assignments for communities or settlements performs authorized body in the field of the environment according to the procedure, established by the Government.
