Article 1. In article 76 of the Criminal code of the Republic of Armenia of April 18, 2003 (further - the Code):

Part 1 to state 1) in the following edition:

"1. Person serving sentence in the form of imprisonment or content in disciplinary battalion after serving of the minimum term of the punishment established by part 3 of this Article can be conditionally ahead of schedule exempted by court from serving sentence if the court as a result of consideration of the conclusion of the independent commission on questions of parole from serving sentence (further - the independent commission) or petitions of the commander of disciplinary battalion on the circumstances provided by parts 1.1 and 1.2 of this Article comes to conclusion that for correction the convict does not need serving of the rest of the imposed penalty as:

In case of parole from serving sentence the convict is not exempted from the additional punishment imposed to it.";

"1.1. In case of assessment of proper conduct of the convict the following circumstances are taken into account:

1) encouragement availability in the course of serving sentence;

2) availability of authority punishment in the course of serving sentence;

3) participation in educational programs, sporting or cultural events or amateur associations of convicts in the course of serving sentence if there was such opportunity;

4) work is at least those months in the course of serving sentence if there was opportunity to work or if evasion from work was not caused by problems with health of the convict;
