About provision of services of telephone mobile cellular communication of GSM (general terms)

(as amended of Resolutions NAREI N35 of December 25, 2003, N33 of November 26, 2004)

SECTION I. GENERAL PROVISIONS

1.1. This provision regulates general terms of provision of services of telephone mobile cellular communication of GSM (further - the services GSM), the relations between the Operator and the Subscriber concerning provision of services of GSM, the rights and obligations of the Parties.

1.2. In this provision the following definitions are given:

The subscriber - physical person or legal entity (the company, the organization, organization) which uses services of telephone mobile cellular communication of the GSM standard with / or without the conclusion of the contract with the Operator.

Activation of SIM-of card - the procedure of introduction in the database of the Operator of information for identification of the Subscriber.

GSM MoU association - the legal entity identified according to the legislation of Switzerland which watches types of activity according to the Memorandum on mutual understanding GSM (GSM MoU).

Recharging card - the card containing quantity of units of time or cash value and which can be used for fee of telephone mobile cellular communication of the GSM standard. The value of card decreases depending on use. The card can be one-time or reusable use, depending on technical characteristics.

SIM card - card which contains identification international subscriber number (IMSI), single in all space of GSM, its ISDN number (MSISDN), irrespective of type of the device GSM used for transfer or call acceptance and also set of services to which the Subscriber has access.

The center of switching of mobile communication - the main device of switching which performs the interface with external networks, and at the same time the station for switching of the proceeding and entering challenges in network of mobile communication.

The PIN code - the password from 4 figures appropriated to SIM card which serves for protection of access to the data included in card. Consecutive wrong introduction of the PIN code automatically blocks SIM card.

Deactivation of SIM card - action which stops fully or partially work to SIM card.

The terminal - the installation or part of installation connected directly or indirectly to terminal point so that transfer, processing and acceptance of information became possible.

GSM - The global system of mobile cellular communication specified in the documents developed by the former group "Groupe Special Mobile" SEPT, standards and technical specifications ETSI.

The list of subscribers - the list of subscribers in alphabetical order with whom the Operator signed the Agreement, with indication of surname, name and number of the mobile phone of the Subscriber.

The memorandum of understanding (MoU) - the document concluded between administrations on communication and operators of the countries of SEPT on September 7 1987, concerning implementation of digital European system of mobile cellular communication with the subsequent amendments.

The operator - the legal entity of the Republic of Moldova, the owner of the license on provision of services of cellular mobile communication of the GSM standard.

Terminal Item - the point of physical connection necessary for access to communication network.

Probability of losses of challenge - probability that attempts to occupy the mobile station deviate by GSM network (share of rejected challenges from number of all challenges).

Probability of interruption of conversation - the frequency with which the conversation of the subscriber of GSM comes to an end before term (share of the talk based on 2-minute theoretical duration i.e. the amount of duration of all talk expressed in minutes divided on 2).

Reactivation of SIM card - action which cancels the procedure of deactivation of SIM card.

Recommendations of GSM - the general term for document package distinguishing the GSM system, developed GSM MoU and/or ETSI.

GSM network - set of the installations of communication established and managed according to recommendations of GSM.

Roaming - possibility of movement and replacement of connection on the radio interface in the waiting condition (when the mobile phone is not used) the mobile phone in zone of servicing of the unique network or between different networks.

Communication services - the services in the field of communication intended for the consumer and rendered for a fee.

The base station - send-receive radio set of the base station (BTS - Base Tranceiver System) and installation of management of the base station (BSC - Base Station Controller).

1.3. The services GSM are provided by the Operator to all users on equal terms. Covering of the territory of the Republic of Moldova the services GSM provided by the Operator correspond to the Development plan for GSM network and conditions stipulated in the license.

1.4. Activities of the Operator are regulated by the legislation of the Republic of Moldova, including:

Law on telecommunication;

The license granted by the Ministry of Transport and Communications, the National agency on regulation in the field of telecommunication and information science or other successor;

This provision;

The laws and regulations of the Republic of Moldova, the regulating documents approved by MTS or other body, successor of MTS.

1.5. According to paragraph 2 of Art. 4 of the Law on telecommunication the Operator and persons working on hiring shall provide confidentiality of the content of telephone conversations, other messages transmitted via means of communication, and also nondisclosure of information on the provided communication services to other persons except the receiver or person authorized by the current legislation.

1.6. The operator establishes independently rates for the rendered services of telephone cellular mobile communication. Rates shall be non-discriminatory, reasonable and are established on the basis of the cost of services of telecommunication.
