About modification of the order of the Government of the Kyrgyz Republic "About approval of Rules about forced separation (allocation) of business entities" of June 11, 2012 No. 391

For the purpose of enhancement of procedures of forced separation (allocation) of business entities, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About approval of Rules about forced separation (allocation) of business entities" of June 11, 2012 No. 391 the following changes:

in Rules about forced separation (allocation) of the business entities approved by the above-stated resolution:

- state Item 6 in the following edition:

"6. Applications (addresses) are submitted in antimonopoly authority in writing, with application of documents, the signs of violation by business entity of the antitrust law confirming availability.";

- the paragraph one of Item 9 to state in the following edition:

"9. The commission of experts is created from specialists of antimonopoly authority and interested persons, whose rights and legitimate interests are infringed in connection with consideration of the case about antitrust violation, involved in the procedure of separation (allocation) of business entity. The commission of experts consists of 5 people. By results of work of commission of experts the conclusion which has advisory nature is constituted, conclusions of the commission are obligatory by consideration of question of separation (allocation) of business entity.";

- in paragraph one of Item 12 of the word "30 days" shall be replaced with words "three months".

2. This resolution becomes effective after fifteen days from the date of official publication.
