About modification and amendments in the Law of Turkmenistan "About environmental assessment" *

I. Bring in the Law of Turkmenistan "About ekologichesyoky examination", adopted on August 16, 2014 (Sheets of Majlis of Turkmenistan, 2014, No. 3, Art. 108; 2016, No. 2, Art. 103; 2018, No. 1, Art. 3), following changes and amendments:

1) in Article 1:

in Items 3 and 7 of the text in state language to replace the word "edilyan" with the word "yetirilyan";

after Item 7 to add with Item of the following content:

"7-1) valuation report of impact on the environment – the component of the project documentation on the planned economic and other activity containing data on results of the carried-out environmental impact assessment and necessary actions for prevention and (or) reduction of the predicted changes of the environment;";

To add 2) after item 4 of Article 3 with Item of the following content:

"4-1) obligation of accounting of requirements of ecological safety when conducting environmental assessment;";

Contents of Article 5 to state 3) in the following edition:

"In Turkmenistan the state environmental assessment, public environmental assessment, and also independent environmental expertize which is carried out in the form of environmental audit are performed.";

4) in Article 11 part two:

state Item 1 in the following edition:

"1) the preproject documentation on development planning of the cities and industries of economy;";

after Item 1 to add with Item of the following content:

"1-1) documentation on the choice of the parcels of land under all types of the planned economic and other activity;";

in Item 3 of the word "materials by assessment" shall be replaced with words "valuation report";

after Item 10 to add with Item of the following content:

"10-1) project documentations of the objects used for placement and (or) neutralization of waste of the I-V classes of danger including the project documentation on construction, reconstruction of these objects;";

To add 5) after part four of Article 18 with part of the following content:
