In pursuance of Article 79 of the Insolvency act N632-XV of November 14, 2001. (The official monitor of the Republic of Moldova, 2001, Art. N139-140, 1082) DECIDES: the Government of the Republic of Moldova

Approve Regulations on remuneration of the managing director of process of insolvency it (is applied).

Regulations on remuneration of the managing director of insolvency process

1. The regulations on remuneration of the managing director of insolvency process (further - the Provision) are developed according to provisions of Article 79 of the Insolvency act N632-XV of November 14, 2001.

2. The regulations on remuneration of the managing director of process of insolvency establish regulation bases the state of remuneration of the managing director in cases when the state is the main creditor.

3. According to Item b) parts (1) Article 64 of the Insolvency act, source of remuneration of the managing director is the money received from use of debit weight.

4. Amount of remuneration of the managing director is established by creditor meeting or creditor committee and makes sure determination of degree of jurisdiction. Determination of degree of jurisdiction shall be brought to the attention the debtor and each member of the committee of creditors.

5. Remuneration of the managing director is performed depending on the amounts directed to satisfaction of requirements of creditors.
