About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on the prevention and suppression of human trafficking No. 241/2005 (Official monitor of the Republic of Moldova, 2005, Art. No. 164-167, 812), with subsequent changes and amendments, to make the following changes and additions:

1. Item b) Article 1 to state in the following edition:

"b) ensuring protection and help to the victims and expected victims of human trafficking;".

2. In Article 2:

1) after the words "human trafficking" to add Item with words "(trade in adults or children)";

2) to declare Item invalid;

in Item 3):

the subitem c) to state in the following edition:

"c) commercial or non-commercial sexual exploitation;";

in the subitem d) to exclude the words "for transplantation";

text: "The consent of the victim of human trafficking to intended operation, stipulated in Item 3), is not taken into account when using any of means of coercion, stipulated in Item 1);" to exclude;

add Article with Items 3-1) and 3-2) of the following content:

"3-1) commercial sexual exploitation - forced use of person for occupation prostitution or in the pornographic industry instead of money or other property benefits;

3-2) non-commercial sexual exploitation - the forced use of person which is not pursuing the mercenary aims expressed in the form of scrap (including polygamous) or cohabitations;";

in Item 7) of the word "condition of the person imprisoned, including freedoms of travel, containing in quality of the hostage" shall be replaced with words "deprivation of person of freedom";

11) to state Item in the following edition:

"11) the victim of human trafficking - physical person which definitely suffered as a result of actions for human trafficking, stipulated in Item 1);";

add Article with Item 11-1) of the following content:
