About entering of amendments into the Code of penal procedure of the Republic of Moldova No. 122/2003

The Parliament adopts this organic law.

Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes and amendments to make the following additions:

1. Part (articles 93 after words "criminal prosecution authority" to add 3) with words ", the stating body".

2. Part (Article 262 to add 1) with Item 3-1) of the following content:

"3-1) protocols on establishment of the crime constituted by the stating bodies provided in part (1) Articles 273 of this Code;".

3. In Article 273:

part (to add 1) with the Item d-1) of the following content:

"d-1) the State Tax Administration - on the crimes provided by Articles 241-242, 244, 244-1, 250-253 and 335-1 Criminal codes;";

part (to add 2) after the word of "protocols" with the words "according to the requirements provided by Articles 260-261 of this Code", and at the end to add with the offer: "The stating statements which are drawn up by these bodies are evidentiary facts.";

add Article with part (6) the following content:

"(6) the Protocol on establishment of crime is the act of notification of criminal prosecution authorities according to Article 262 of this Code and cannot be subjected to control administratively.".

Art. II. - (1) This law becomes effective since October 1, 2018.

(2) to the Government in three-months time from the moment of publication of this law:

a) provide to Parliament of the offer on reduction of the current legislation to compliance with this law;

b) bring the regulations into accord with this law.
