About modification and amendments in some legal acts

Art. I. - Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: 2009, Art. No. 72-74, 195), with subsequent changes and amendments to add the official monitor of the Republic of Moldova with Article 326-1 of the following content:

"Article 326-1. Fulfillment of duties in the public sector in situation of conflict of interest

(1) Act of the public figure which in case of execution of the service duties considered applications, petitions or claims adopted the administrative act, made directly or by means of the third party the transaction, made the decision or participated in decision making for the purpose of obtaining, directly or indirectly, property benefit which cost exceeds 10000 conventional units, for itself or the close person determined in the Law on declaring of property and private interests No. 133/2016, if the conflict of interest was not declared and resolved according to provisions of the legislation on declaring and control of property and private interests, it is punished by penalty in the amount of 10000 to 15000 conventional units or imprisonment for a period of up to 3 years with deprivation in both cases of the right to hold the state positions for a period of 5 up to 7 years.

(2) the Act provided by part (1), committed:

a) person who is taking up responsible state position;

b) in connection with negotiating, management or execution of means from public or external funds, it is punished by penalty in the amount of 15000 to 20000 conventional units or imprisonment for a period of 2 up to 5 years with deprivation in both cases of the right to hold the state positions for a period of 5 up to 10 years.

(3) Provisions of this Article are not applied in case of removal, approval or adoption of regulations.".
