About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In the Law on financial institutions No. 550/1995 (repeated publication: The official monitor of the Republic of Moldova, 2011, Art. No. 78-81, 199), with subsequent changes and amendments to make the following change and addition:
1. Parts (7) and (Article 38-11 to state 8) in the following edition:
"(7) Repayment of the subordinated debts except for issued according to article 52-1 of the Law on activities of banks No. 202/2017, is performed after repayment of requirements of all creditors of bank, but before repayment of requirements of shareholders, former owners of share in the authorized capital of bank to whom the measures for cancellation and new share issue provided by the law, and creditors who own the requirement to bank connected with the subordinated debts issued according to article 52-1 of the Law on activities of banks No. 202/2017 were applied.
(8) the Assets which remained after repayment of all requirements to bank are distributed to its shareholders, the former owners of share in the authorized capital of bank to whom the measures for cancellation and new share issue provided by the law were applied if they own the requirement to bank following from cancellation of the shares withheld by them according to their shares and creditors who own the requirement to bank connected with the subordinated debts issued according to article 52-1 of the Law on activities of banks No. 202/2017.".
2. Add Article 38-17 with parts (3-1) and (3-2) following of content:
"(3-1) Repayment of subordinated debts, others by what issued according to article 52-1 of the Law on activities of banks No. 202/2017, are performed after repayment of requirements of all creditors of bank, but before repayment of the requirements provided by part (3-2) these Articles.
