About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In the Law on the National commission on the financial market No. 192/1998 (repeated publication: The official monitor of the Republic of Moldova, 2007, No. 117-126BIS), with subsequent changes and amendments to make the following changes and additions:
1. Add Article 4 with part (6) the following content:
"(6) Provisions of the Law on regulation of business activity by permission No. 160/2011 in the non-bank financial market are not applied.".
2. In Item f) Article 8 of the word "within the powers;" shall be replaced with words "within powers and according to the procedure established by the regulations;".
3. State Article 20 in the following edition:
"Art. 20. - For implementation of the powers the National commission publishes decisions in the form of regulations (resolution) and individual acts (resolutions, orders and records of sentence) which are signed by the chairman or in its absence the authorized vice-chairman. Features of the publication of individual acts are established by own regulations.".
4. Recognize Article 21 invalid.
5. In Article 22:
parts (1) - (To state 3) in the following edition:
"(1) the Regulations of the National commission obligatory for members of the non-bank financial market, are published in the Official monitor of the Republic of Moldova and become effective or from the date of their publication, or from other date provided in the text of the relevant act.
(2) Regulations of the National commission can be disputed only by person concerning whom the individual act is adopted or concerning which it is refused adoption of the individual act based on the disputed regulation. The regulation based on which the individual act is adopted or it is refused adoption of the individual act can be disputed only along with contest of the individual act.
