About introduction of amendments to the Federal law "About Accreditation in National Accreditation System" and separate legal acts of the Russian Federation regarding enhancement of procedure for accreditation

Article 1

Bring in the Federal Law of December 28, 2013 No. 412-FZ "About accreditation in national accreditation system" (The Russian Federation Code, 2013, No. 52, Art. 6977; 2014, No. 26, Art. 3366; 2016, No. 10, Art. 1323) following changes:

1) in Article 2:

a) in part 2 to replace the word "Features" with the word "Procedure", the word is "established" to be replaced with the word "is established";

b) add with part 8 of the following content:

"8. The procedure for accreditation in the field of space activities is established by the legislation of the Russian Federation in the field of space activities.";

2) in Article 4:

a) state Item 2 in the following edition:

"2) the statement from the register of accredited persons (the certificate of accreditation) - the document created in the automatic mode by means of federal state information system in the field of accreditation and certifying accreditation in certain area of accreditation at the time of its forming;";

"9. 1) updating of area of accreditation - the change of the description of area of accreditation performed at the initiative of accredited person within the procedure of confirmation of competence and (or) of other cases determined by national authority by accreditation, in connection with change of the description of separate elements of form of area of accreditation and (or) included in the area of accreditation of documents according to which accredited person performs works and (or) renders services in assessment of conformity (including in connection with the edition of such documents in the new edition or the edition of the documents replacing or supplementing the specified documents);";

3) in Article 7:

a) add with Item 1.1 of the following content:

"1. 1) approval of the list of discrepancies of the applicant to accreditation criterions which when implementing accreditation involve refusal in accreditation (further - the list of the discrepancies involving refusal in accreditation), the list of discrepancies of accredited person to requirements of the legislation of the Russian Federation to activities of the accredited persons involving accreditation action suspension (further - the list of the discrepancies involving accreditation action suspension);";

b) declare Item 2 invalid;

c) in Item 3 of the word "statements for issue of the certificate of accreditation on paper, statements for issue of the duplicate of the certificate of accreditation," to exclude;

d) state Item 8 in the following edition:

"8) establishment of images of sign of national accreditation system, including in combination with signs of the international organizations for accreditation, and procedure for their application;";

4) in Article 8:

a) to state Item 5 of part 1 in the following edition:

"5) the organization of forming and maintaining registers of the certificates of conformity issued by accredited persons, registers of declarations of conformity, including national part of the Unified register of the issued certificates of conformity and the registered declarations of conformity, and provisions of data from the specified registers, and also forming and maintaining the specified registers according to the procedure, established by the legislation of the Russian Federation taking into account the right of the Eurasian Economic Union, and provision of data from them;";

b) add with part 1.1 following of content:

"1.1. By national authority on accreditation for the purpose of decision making, specified in parts 28, of the 30th Article 17, to part 19 of Article 24, article 24.1 of this Federal Law, the technical commissions, technical groups acting according to the regulations on them approved by national authority on accreditation can be created.";

c) add with part 2.1 following of content:

"2.1. The national authority on accreditation has the right to involve federal state institution subordinated to it in scientific methodically, information and technical supply of the activities, including in document handling, conducting necessary examinations, holding actions for assessment of conformity of the applicant, accredited person, verification of the acts of examinations and the conclusions arriving in national authority on accreditation, the organization of holding actions for prevention of violations by accredited persons of requirements of the legislation of the Russian Federation to activities of accredited persons, actions for federal state control of activities of the accredited persons performed without interaction with accredited persons, to systematic observation of execution by accredited persons of the specified requirements, the analysis and forecasting of execution of the specified requirements.";

d) add with part 2.2 following of content:

"2.2. Subordinated to national authority on accreditation the federal state institution performs (including on paid basis) the actions directed to increase in competence of personnel of national accreditation system realizes programs of check of their qualification and performs functions of the expert organization. The documents containing requirements of quality management system of the specified organization shall provide the provisions which are not allowing emergence of conflict of interest.";

e) state part 3 in the following edition:

"3. The national authority on accreditation when implementing of the powers assigned to it requests and receives on a grant basis documents and (or) information, including data, components the state, tax, commercial, protected by the law other secret, from state bodies, local government bodies or subordinated to state bodies or local government bodies of the organizations at which disposal these documents and (or) information, including with use of single system of interdepartmental electronic interaction are. Data, components the state, tax, commercial, protected by the law other secret, other data, access to which is limited by the Federal Laws, received by national authority on accreditation when implementing the powers, are not subject to disclosure, except as specified, established by the legislation of the Russian Federation.";

e) add with part 5 of the following content:

"5. Officials of national authority on accreditation when holding actions for assessment of conformity of the applicant, accredited person to accreditation criterions, actions for federal state control of activities of accredited persons have the right:
