About investment of property by residents outside Ukraine

For the purpose of ensuring the external economic interests of Ukraine and according to part two of article 26 of the Constitutional Contract between the President of Ukraine and the Supreme Council of Ukraine "About the main beginnings of the organization and functioning of the government and local self-government in Ukraine for the period before adoption of the new Constitution of Ukraine" I decide:

1. Determine that residents can invest property outside Ukraine for the purpose of:

entering into authorized capitals of the companies created abroad;

fixing to branches, representations with other separate divisions for accomplishment of the tasks assigned to them.

2. Investments abroad can be performed in the form of property rights and property, except raw materials, components and spare parts, consumer goods, and also such which according to the current legislation are carried to highly liquid and concerning which export licensing, quoting or the special mode are provided.

Any property according to this Article is estimated in foreign convertible currency on the basis of the prices of the international markets.

3. Investment of property outside Ukraine is subject to licensing.

Issue of individual licenses on carrying out such investment is performed by the Ministry of Economics of Ukraine.

4. Determine that sale of the property invested according to this Decree is commodity export, at the same time revenue in foreign currency received as a result of their sale is subject to transfer into accounts of residents in authorized banks in the debt payment due dates specified in contracts, but no later than 90 days from the moment of signing of the act or other document certifying sale of values.

8. Operation of this Decree does not extend to investment of currency values outside Ukraine.
