Article 1. To state Item 3 of part 1 of Article 170 of the Civil code of the Republic of Armenia of May 5, 1998 (further – the Code) in the following edition:

"3) the servitude, including personal servitude;".

Article 2. Article 210-217 of the Code to state in the following edition:

"Article 210. Rights of limited use of someone else's property (servitudes)

1. The rights of limited use of someone else's property are:

1) property servitude;

2) personal limited servitude;

3) personal full servitude (usufruct);

4) right to use by premises.

Article 211. Property servitude

1. The parcel of land or other real estate (serving property) can be encumbered for benefit of the owner of other parcel of land or real estate (priority property) so that the owner of priority property could use restrictedly office property (the positive servitude) or to prohibit to the owner of office property to use somehow this property (the negative servitude).

2. The property servitude can be established upon the demand of the owner of the priority property or person having the right to building.

3. In case of encumbrance of real estate by the property servitude the owner of real estate does not lose rights of possession, use and the order of this real estate which can perform without violation of the restrictions provided by the servitude.

4. The property servitude cannot be independent subject of purchase and sale, pledge, lease or any other transaction, except for agreements between the parties on establishment of the property servitude, stipulated in Article 213th of this Code.

5. The property servitude can be voluntary or forced.
