About modification and amendments in the Economic Procedure Code of the Republic of Tajikistan

Article 1. Bring in the Economic Procedure Code of the Republic of Tajikistan accepted by the Law of the Republic of Tajikistan of January 5, 2008 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2008, No. 1, h 1, the Art. 4, Art. 5; 2011, No. 12, Art. 840; 2012, No. 7, Art. 719; 2013, No. 3, Art. 180; 2015, No. 11, Art. 954; 2017, No. 5, h 1, Art. 277; 2018, No. 1, Art. 7), following changes and amendments:

1. The paragraph one of article 28 after words of "officials" to add with words ", and also the legal executive".

2. Add Article 48 with part 6 of the following content;

"6. In case of change of the basis or subject of action, increase or reduction of claims, the expiration of the consideration of the case provided by this Code begins from the date of execution of the corresponding legal proceedings.".

3. In Article 124:

- the ninth parts 2 after the words "before presentation of the claim" to add the paragraph with the words "or in necessary cases, the petition for acceptance of interim measures";

- regarding 3 words of "the defendant, his representative" shall be replaced with words "the claimant, his representative, the defendant".

4. To state part 4 of Article 138 in the following edition:

"4. The court approves by the determination the voluntary settlement of the parties and stops proceeedings.".

5. To add part 2 of article 139 after the word "other" with words ", and also in it effects of failure to carry out of conditions of the voluntary settlement shall be specified.".
