About modification of some legal acts of Ukraine concerning settlement of holding some phytosanitary procedures

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Verkhovna Rada of USSR, 1984, appendix to No. 51, the Art. 1122):

Chapter 13 to add 1) with Article 172-1-1 of the following content:

"Article 172-1-1. Violation by officials of phytosanitary laboratory of the legislation of Ukraine on quarantine of plants

Violation by officials of phytosanitary laboratory of the legislation, repeated within year, on quarantine of plants regarding conducting phytosanitary examination (analyses) which had the investigation obtaining from the importing country of two and more notifications about discrepancy to phytosanitary measures according to the International standard for phytosanitary measures No. 13,

involves imposing of penalty on officials from hundred to two hundred free minima income of citizens";

Part one of Article 238-2 to add 2) with words and figures "violation by officials of phytosanitary laboratory of the legislation on quarantine of plants (Article 172-1-1)".

2. In the Law of Ukraine "About quarantine of plants" (Sheets of the Verkhovna Rada of Ukraine, 2006, No. 19-20, of Art. 167 with subsequent changes):

1) in Article 1:

in part one:

add taking into account alphabetic procedure with terms of the following content:

"arbitral sample - the part of average test which is selected from subject to regulation which according to the characteristics is equivalent to sample and is intended for conducting repeated phytosanitary (arbitral) examination (analyses);

dredging - the pointed sample taken at one time from one batch or its certain part;

visual check - physical control of subjects to regulation naked eye by means of magnifying glass, binokulyar or microscope for the purpose of identification of harmful organisms without conducting phytosanitary examination (analyses);
