About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. To state Article 314.1 of the code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:

"Article 314.1 Judicial sanctions and general procedure for their application

1. On the bases provided by the Constitutional law "Judicial Code of the Republic of Armenia" court has the right to apply to persons participating in criminal trial and persons which are present at judicial session, the following sanctions:

1) note;

2) removal from the hall of judicial sessions;

3) judicial penalty.

2. The judge in need of clear to form warns about competence of court to apply judicial sanctions, explains the bases and effects of application of the judicial sanction.

3. In case of application of the judicial sanction against person which is present at the hall of judicial sessions, the court if necessary gives it the chance to express. The refusal to person participating in criminal trial in provision of opportunity to express in case of application of penalty or removal from the hall of judicial sessions shall be proved by court.

4. If person accepts illegality of the act and apologizes to court, then the sanction against the specified person can not be applied.

5. If person which is subject to the judicial sanction abuses the right provided by parts 3 and 4 of this Article and uses the right to express for continuation of the act which is the basis for application of the judicial sanction, or making of new act, then the judge is competent to apply more tough judicial sanction to this person.

6. If the court finds what the participant of criminal trial or the other person who is present at meeting showed behavior concerning court or made act which attracts criminal liability, then the court applies to it the judicial sanction and addresses the prosecutor with the petition for initiation of legal proceedings.".
