About modification and amendments in the Law of the Republic of Tajikistan "About liquidation of credit institutions"

Article 1. Bring in the Law of the Republic of Tajikistan of June 28, 2011 "About liquidation of credit institutions" (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2011, No. 6, Art. 432; 2012, No. 7, Art. 701) following changes and amendments:

1. In Article 2:

- to consider the text of Article part 1 and to number;

- add with part 2 following of content:

"2. In case of discrepancy of provisions of this Law with the provisions of other regulatory legal acts of the Republic of Tajikistan connected with liquidation of credit institutions provisions of this Law are applied.".

2. Add article 12 with part 3 following of content:

"3. The expenses connected with actions of the administrator are paid for the account of credit institution. The size of expenses of the administrator is established by National Bank of Tajikistan. The established expenses of the administrator are paid other requirements for credit institution forward.".

3. To state part 1 of Article 35 in the following edition:

"1. Assets of the credit institution which is in process of involuntary liquidation are distributed in the following procedure:

- the means spent for process of involuntary liquidation and appointment of the liquidator or special administrator;

- the salary to employees of credit institution, except for payments to members of the Supervisory board, added on the date of decision making about opening of legal proceedings on the case of involuntary liquidation;

- the loans granted by the Government of the Republic of Tajikistan or National Bank of Tajikistan of credit institution;
