About modification of some legal acts
The Parliament adopts this organic law.
Art. I. - Part disposition (1) article 237 of the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: 2009, Art. No. 72-74, 195), with subsequent changes, after words of "credit cards" to add the official monitor of the Republic of Moldova with words ", coupons on food".
Art. II. - In the Code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: The official monitor of the Republic of Moldova, 2017, Art. No. 78-84, 100), with subsequent changes to make the following changes:
1. Add the code with Article 272-1 of the following content:
"Article 272-1. Violation of the law about coupons on food
(1) Sale for sum of money or voluntary conveyance of paper and/or electronic coupons by physical persons on food to other persons attracts imposing of penalty on physical persons in the amount of 20 to 100 conventional units.
(2) Provision by the employer to the worker of bigger number of paper and/or electronic coupons on food, than the number of the days which are actually worked him within the last month attracts imposing of penalty on physical persons or legal entities of public or private law who hire workers on the basis of the individual employment contract, in the amount of 1 to 1,5 of conventional unit for each excess coupon on food.
(3) Decrease by the employer to receivers of coupons on food of the accrued payroll provided by the individual employment contract, the collective employment contract and/or the collective agreement attracts imposing of penalty on physical persons in the amount of 100 to 500 conventional units and on legal entities of public or private law in the amount of 300 to 1000 conventional units for each case of decrease to one worker.
(4) the Failure to provide attracts with the operator of destruction of paper coupons on food after six months after their obtaining from the trade companies / catering establishments imposing of penalty on legal persons operators in the amount of 50 to 250 conventional units.
