Article 1. To add the code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) with Article 431.1 of the following content:

"Article 431.1. Replacement of penalty with social jobs

1. The court replaces penalty or unpaid part of penalty with social jobs in cases of impossibility of payment of penalty, and also malicious evasion from payment of penalty.

2. The question of replacement of penalty or unpaid part of penalty with social jobs is considered by court according to the petition of the body performing punishment or the convict.

3. The burden of the proof of impossibility of payment of penalty is born by the convict.

4. The court determines impossibility of payment of penalty or malicious evasion from its payment taking into account the submitted petition for replacement of penalty with social jobs, explanations of the convict or his lawyer in connection with failure to pay penalty and the submitted documents.".

Article 2. Part 4 of article 437 of the Code after words "the direction of the convict for serving sentence" to add with words ", replacements of penalty or unpaid part of penalty with social jobs".

Article 3. This Law becomes effective for the tenth day after its official publication.
