About approval of the General provision about regional customs authority

According to subitem 6.4 of the Regulations on the Federal Customs Service approved by the order of the Government of the Russian Federation of September 16, 2013 No. 809 (The Russian Federation Code, 2013, No. 38, Art. 4823; 2017, to No. 25, of the Art. 3689), I order:

1. Approve the General provision about regional customs authority (appendix).

2. To regional customs authorities to perform activities based on the General provision about regional customs authority specified in Item 1 of this order.

3. Recognize invalid Item 1 regarding the General provision on regional customs authority and Item 2 of the order of FCS of Russia of September 4, 2014 as No. 1700 "About approval of the General provision about regional customs authority and the General provision about customs" (it is registered by the Ministry of Justice of the Russian Federation 24.12. 2014, registration No. 35376).

4. To impose control of execution of this order on the deputy manager of FCS of Russia T. N. Golendeeva.

This order becomes effective after 30 days after day of its official publication.

The general provision about regional customs authority

I. General provisions

1. The regional customs authority (further - the MOUTH) is the customs authority entering single federal centralized system of customs authorities of the Russian Federation and providing realization of tasks and functions of FCS of Russia in the region of activities to the MOUTH within the competence determined by this provision.

2. The region of activities to the MOUTH determines FCS of Russia.

3. To the MOUTH in the activities is guided by the Constitution of the Russian Federation, the Federal constitutional Laws, international treaties of the Russian Federation, acts constituting the right of the Eurasian Economic Union, the legislation of the Russian Federation, acts of the President of the Russian Federation and the Government of the Russian Federation, acts of bodies of currency control, regulatory legal acts of federal executive bodies, regulations of the Bank of Russia, normative and other legal acts of the Ministry of Finance of the Russian Federation and FCS of Russia, and also this provision.

4. To the MOUTH performs the activities in interaction with the plenipotentiary of the President of the Russian Federation in the federal district, territorial authorities of other federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies, legal entities and physical persons, public associations and other organizations.

5. To the MOUTH performs management of activities of the customs and customs posts subordinated to the MOUTH, which are in the region of activities to the MOUTH (further - subordinate customs authorities), except for the customs which is directly subordinated to FCS of Russia and is in relation to them higher customs authority.

II. Powers

6. To the MOUTH performs the following powers in the established field of activity:

1) control of implementation by subordinate customs authorities of the customs transactions connected with commodity importation on customs area of the Eurasian Economic Union and their export from customs area of the Eurasian Economic Union, transportation of goods on customs area of the Eurasian Economic Union and also with goods placement under customs procedure, uniform application of procedure of customs transactions, observance of conditions of the room under customs procedures, uses of goods according to the declared customs procedure and carrying out customs control;

2) the organization and control of use by subordinate customs authorities of the preliminary information submitted concerning the goods imported on customs area of the Eurasian Economic Union by different types of transport;

3) the organization and holding the actions directed to involvement of participants of foreign economic activity and also other interested persons to use of perspective customs technologies;

4) participation in limits of competence of development of offers on procedure for application of forms of customs control, the measures providing carrying out customs control, and measures for risk minimization;

5) ensuring compliance with prohibitions and the restrictions set according to the acts constituting the right of the Eurasian Economic Union and the legislation of the Russian Federation;

6) ensuring application by customs authorities of measures of export control, including died concerning military products, established by the legislation of the Russian Federation;

7) the organization, coordination, the analysis and control of the activities of subordinate customs authorities performed including on the basis of risk management system, on providing and observance of prohibitions and restrictions, protection of the rights to intellectual property items, requirements of acts of the foreign exchange legislation and acts of the bodies of currency control established according to the acts constituting the right of the Eurasian Economic Union, the legislation of the Russian Federation, and also international treaties of the Russian Federation;
