"If the regulated organization owns heat supply objects which are in the state-owned or municipal property based on the concessionary agreement signed without carrying out tender according to provisions of articles 51 and 52 of the Federal law "About Concessionary Agreements" and as a part of the indicators of energy saving and energy efficiency established by the concessionary agreement the wastage rate of heat energy (heat carrier) is provided, the wastage rate of heat energy (heat carrier) specified in the concessionary agreement for the corresponding year of action of the concessionary agreement is applied to regulation of rates for heat energy.";

to add paragraph two of Item 51 with words ", and values of the long-term parameters of regulation of activities of the concessionary provided by the concessionary agreement signed without carrying out tender with persons who have rights of possession and uses of the property which is subject of the concessionary agreement arose based on lease agreements according to provisions of article 51 of the Federal law "About Concessionary Agreements", or in case of the conclusion of the concessionary agreement with person who took the initiative of the conclusion of the concessionary agreement";

add with Item 52 (2) the following content:

"52(2). If after one calendar year after entry into force of the concessionary agreement the property right of the concedent to the unregistered real estate understood in the value provided by part 5 of article 39 of the Federal law "About Concessionary Agreements", and (or) encumbrance of such right were not registered by the regulated organization as the concessionary according to part 15 of article 3 of the specified Federal Law, in case of establishment (adjustment) of rates after one calendar year after entry into force of the concessionary agreement the expenses of the regulated organization connected with remuneration payment to the guarantor for issue of the bank guarantee provided by the regulated organization as the concessionary for the purpose of ensuring obligation fulfillment according to the concessionary agreement, and also expenses of the regulated organization as the concessionary on compensation to the guarantor of the amount are not considered paid by the guarantor to the concedent in accordance with the terms of the bank guarantee regarding the size of money relating to ensuring obligation fulfillment of the concessionary on ensuring state registration of the property right of the concedent to the unregistered real estate and (or) encumbrances of this right.";
