About modification of the Order of the Government of the Russian Federation of May 10, 2017 No. 549

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of May 10, 2017 No. 549 "About the state guarantees of the Russian Federation on the credits or bonded loans attracted by legal entities on the purposes established by the Government of the Russian Federation within the measures directed to the solution of pressing tasks on ensuring stability of economic development" (The Russian Federation Code, 2017, No. 21, the Art. 3002).

2. This resolution becomes effective from the date of its official publication.

Changes which are made to the Order of the Government of the Russian Federation of May 10, 2017 No. 549

1. In paragraph one of Item 2 of the word "in 2017" shall be replaced with words "in 2017 - 2018".

2. Add Item 3 with the paragraph of the following content:

"Selection of principals for rendering the state warranty support in 2018 according to Rules is performed till November 1, 2018".

3. In item 4 of the word "in 2017" shall be replaced with words "in 2017 - 2018".

4. In Item 5:

The words "in 2017" shall be replaced with words 1) "in 2017 - 2018";

2) in the subitem "an" of the word", including in the presence at it arrears according to monetary commitments to the Russian Federation and (or) on obligatory payments in budgets of budget system of the Russian Federation which principal is not capable to extinguish (further - overdue debt)" to exclude;

5. In Item 7:

Subitems "an" and "b" to state 1) in the following edition:

"a) selection of principals for rendering the state warranty support according to Rules in cases and on the conditions specified in Item 5 of this resolution is performed by the Government Commission on Economic Development and Integration formed by the order of the Government of the Russian Federation of December 30, 2009 No. 1166 "About Government Commission on Economic Development and Integration" (further - Government commission), on representation to the relevant interdepartmental commission specified in the subitem "an" of Item 7 of Rules.

The decision of Government commission on selection of principal is submitted in the Ministry of Finance of the Russian Federation, to the agent of the Government of the Russian Federation specified in Item 11 of Rules (further - the agent of the Government of the Russian Federation), and in the authorized federal executive body specified in Item 8 of Rules.

The Ministry of Finance of the Russian Federation based on the decision on selection of principal, and also documents submitted by principal according to the paragraph the fourth this subitem, within 5 working days from the date of obtaining specified decisions on selection and documents performs in accordance with the established procedure preparation of the draft of the act of the Government of the Russian Federation of provision of a guarantee.

For preparation by the Ministry of Finance of the Russian Federation of the draft of the act of the Government of the Russian Federation of provision of a guarantee the principal selected in accordance with the established procedure and (or) the creditor submit to the Ministry of Finance of the Russian Federation the documents specified in Item 2 of appendix No. 1 or Item 2 of appendix No. 2 to Rules (depending on borrowing type), in Item 2 of appendix No. 3 (if as providing the guarantee or the bank guarantee is offered) and (or) in the subitem "an" of Item 3 of appendix No. 4 (if as providing pledge of property of the legal entity who is not principal is offered) to Rules.

In the act of the Government of the Russian Federation of provision of a guarantee specified in the subitem "an" or the subitem "v" of Item 5 of this resolution data, stipulated in Item 46 or Item 66 of Rules are specified (depending on borrowing type);

b) in the decision of Government commission on selection of the principal specified in the subitem "an" of Item 5 of this resolution for rendering the state warranty support in addition to data, stipulated in Item 46 or Item 66 of Rules (depending on borrowing type), data on unsatisfactory financial condition of principal, the motivated conclusion about the circumstances proving the special importance of principal for separate industries of economy and need of rendering the state warranty support to it according to Rules in case of unsatisfactory financial condition are specified.

In case of adoption by the Government of the Russian Federation of the decision on provision of a guarantee according to obligations of the principal having unsatisfactory financial condition, the agent of the Government of the Russian Federation according to the subitem "b" of Item 24 of Rules represents to the Ministry of Finance of the Russian Federation the conclusion containing unambiguous conclusions about possibility of decision making about the conclusion of the agreement on provision of a guarantee, and the Ministry of Finance of the Russian Federation accepts according to Item 28 of Rules the decision on the conclusion of the agreement on provision of a guarantee without analysis results of financial condition of principal.

In case of adoption by the Government of the Russian Federation of the decision on provision of a guarantee according to obligations of the principal having unsatisfactory financial condition, provisions of the subitem "v" of item 4 and the subitem "b" of Item 26 of Rules are not applied;";
