Article 1. ZR-305 "About content of detainees and the arrested persons" (further - the Law) before the word of "defender" to add Item 3 of part 1 of article 13 of the Law of the Republic of Armenia of February 6, 2002 with the word of "lawyer".
Article 2. In article 15 of the Law:
Part 1 to replace 1) with new parts of the following content:
"The detained or arrested person has the right to free appointment alone to the lawyer who kept the appointment for the purpose of to undertake its protection, or with the defender, without restriction of quantity and duration of appointments, irrespective of the working days or hours.
Based on the petition of the arrested person the decision of the body performing criminal proceedings to it permits also free appointments alone to the lawyer who is not the defender on criminal case without restriction of quantity or duration of appointments if it is connected with need of rendering to the arrested person of the legal aid which is not connected with consideration of criminal case. Consideration and the solution of the specified petition by the body performing criminal proceedings, and also appeal by the arrested person of the decision made in connection with it are performed according to the procedure, established by the Code of penal procedure of the Republic of Armenia.
The appointment of the detainee or the arrested person with the lawyer or the defender is provided in that case when the lawyer or the defender represent the identity certificate and license for activities or the certificate of the lawyer based on the appropriate certificate directed by the body performing criminal proceedings, administrations of the place of content of detainees or arrested. The body performing criminal proceedings sends the certificate specified in this part, administration of the place of content of detainees or arrested without delay.
