About modification of the Criminal Procedure Code of Ukraine concerning enhancement of ensuring compliance with the rights of participants of criminal proceedings and other persons law enforcement agencies during implementation of pre-judicial investigation

The Verkhovna Rada of Ukraine decides:

I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) the following changes:

Article 130 to add 1) with part two of the following content:

"2. The state, having compensated the harm done by the investigator, the prosecutor applies the right of the return requirement to these persons in case of establishment in their actions of structure of criminal offense on conviction of court which took legal effect, or minor offense irrespective of the expiration of terms of application and action of authority punishment";

Article 220 part one after words of "legal proceedings" to add 2) with the words "and in the cases established by this Code, the other person, the rights or legitimate interests of which are limited during pre-judicial investigation, or his representative";

3) in Article 284:

the eleventh parts one to replace the paragraph with two paragraphs of such content:

"9-1) there is not repealed resolution of the investigator, prosecutor on closing of criminal proceedings on the bases provided by Items 1, of 2, of 4, of the 9th this part in criminal proceedings concerning the same act which was investigated with observance of requirements for competence.

Participants of criminal trial have the right to declare petitions to the investigator, the prosecutor closing of criminal proceedings in the presence of the bases provided by this Item".

With respect thereto the twelfth and thirteenth to consider paragraphs respectively paragraphs the thirteenth and fourteenth;

in the paragraph the second parts four and the seventh figure "10" to replace with figures "9-1";
