About modification of some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on the state fee No. 1216/1992 (repeated publication: The official monitor of the Republic of Moldova, 2004, Art. No. 53-55, 302), with subsequent changes to make the following changes:

1. In Article 3:

in the subitem d) Item 1) words "incapacitated owing to mental disorder or weak-mindedness," shall be replaced with words "concerning which the judicial measure of protection is established,";

in the subitem b) Item 2) words "incapacitated owing to mental disorder or weak-mindedness," shall be replaced with words "concerning which the judicial measure of protection is established,".

2. In Item 2) parts (2) Article 4 of the word "incapacitated in connection with mental disease or weak-mindedness," shall be replaced with words "concerning which the judicial measure of protection is established,".

3. In Item 3) Article 7 of the word "incapacitated person." shall be replaced with words "person who in the considered civil case has no civil procedural capacity to act.".

Art. II. - In the Law on bonds of national property No. 1345/1993 (Monitor of Parliament of the Republic of Moldova, 1993, No. 5, of the Art. 130), with subsequent changes, to make the following changes:

1. In Article 2:

part (to state 5) in the following edition:

"(5) Interests of the minor owner of the check of national property and the owner of the check of national property concerning which the judicial measure of protection is established are represented by his parents or, respectively, person responsible for protection, according to the current legislation.";

part (to recognize 6) invalid.

2. In part (Article 7 of the word "can authorize for this purpose any capable person by proxy, certified notarially." shall be replaced with words 4) "can receive the check of national property through the representative authorized by the notarized power of attorney.".
