About modification of some legislative acts of Ukraine concerning crediting renewal

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Civil code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356):

Article 543 to add 1) with part five of such content:

"5. Liquidation of the solidary debtor - the legal entity, the death of the solidary debtor - physical person do not stop obligation of other solidary debtors before the creditor and do not change its amount and conditions of accomplishment";

Part third of Article 554 to state 2) in the following edition:

"3. Persons who on one or according to several guarantee agreements were charged before the creditor for execution by the debtor of the same obligation are solidary debtors and answer to the creditor solidary if other is not established by the guarantee agreement";

3) in Article 559:

state part one in the following edition:

"1. The guarantee stops with the termination of the obligation provided to them. In case of change of the obligation without the consent of the guarantor owing to what the scope of responsibility of the debtor increased, such guarantor bears responsibility for violation of the obligation the debtor in amount which existed before change of the obligation";

in part three of the word "if the guarantor was not charged for the new debtor" shall be replaced with words "if the guarantor did not agree to provide accomplishment of the obligation by other debtor in the guarantee agreement in case of transfer of debt";
