solved:

1. Make changes to paragraph 15 of Regulations of the Constitutional Court of the Russian Federation, having stated it in the following edition:

"§ 15. The termination of powers of the judge in view of achievement of age limit of continuance in office by it

1. In two months prior to achievement by the judge (except for the Chairman of the Constitutional Court) age limit of continuance in office the Constitutional Court informs the President of the Russian Federation and the Federation Council on the forthcoming discovery of vacancy. In case of achievement by the judge (except for the Chairman of the Constitutional Court) 70 years, and the judge appointed to position of the vice-chairman of the Constitutional Court - 76 years the Constitutional Court makes the decision in which states the termination of powers of the judge from the established date, appoints to it the monthly perpetual maintenance. If in case of disposal of the judge from structure of the Constitutional Court the number of judges appears less than two thirds of total number of judges, the judge continues to fulfill the duties before position assignment of the new judge.

2. If upon termination of month in which to the judge 70 years were performed (to the judge appointed to position of the vice-chairman of the Constitutional Court - 76 years), case which hearing is carried out with its participation is not complete, the judge shall continue to fulfill the duties before adoption of the final decision on this case.".
