About introduction of amendments to some orders of the Minister of Agriculture of the Republic of Kazakhstan

I ORDER:

1. Bring the following changes in some orders of the Minister of Agriculture of the Republic of Kazakhstan:

1) in the order of the Minister of Agriculture of the Republic of Kazakhstan of April 6, 2015 No. 4-4/305 "About approval of Rules of subsidizing of cost of fertilizers (except for organic)" (it is registered in the Register of state registration of regulatory legal acts No. 11223, it is published on July 2, 2015 in information system of law of Ad_let):

in Rules of subsidizing of cost of the fertilizers (except for organic) approved by the specified order:

state Item 2 in the following edition:

"2. In these rules the following basic concepts are used:

1) personal account - set of the records containing in the register, allowing to identify the registered person for the purpose of registration of requests (translated requests) for subsidizing and accounting of transactions on them;

2) the service provider - person providing access to information system of subsidizing and its maintenance which is determined by Deraptment of Agriculture of local executive body of area (further - management of area), the cities of republican value or Management on investments and development of entrepreneurship of the capital (further - city department) according to the legislation on public procurements;

3) domestic manufacturer of fertilizers (further - producer of fertilizers) - the physical person or legal entity which is resident of the Republic of Kazakhstan, performing production of fertilizers (except for organic) in the Republic of Kazakhstan and registered them;

4) the request - the electronic request for obtaining by agricultural producer (further - agricultural producer) or agricultural cooperative (further - agricultural cooperative) subsidies for the acquired fertilizers at full cost;

5) the translated request - the electronic request for receipt of subsidies by the producer of fertilizers for acquired by agricultural producer (agricultural cooperative) of fertilizer at the reduced the price cost;

6) the electronic register of requests for subsidizing (further - the register) - set of data on requests for subsidizing of agro-industrial complex, and also about borrowers, financial institutions, and other data reflected in information system of subsidizing;

7) information system of subsidizing - the organizational arranged set of information and communication technologies, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving interaction opportunity with the web portal of "the electronic government", registration of the request (the translated request) for receipt of subsidies, and also its processings by means of automatic verification of the request (the translated request) for compliance to subsidizing conditions;

8) the electronic map of the field - information on the field located on the parcel of land of agricultural purpose, including coordinates of rotary points, information on crop rotations in the last two years and data from satellites of remote sensing of the earth;

9) the supplier of fertilizers - the physical person or legal entity which is enabling the realization of fertilizers (except for organic) foreign production, registered them;

10) the seller of fertilizers - producer of fertilizers, the supplier of fertilizers or foreign producer of fertilizers;

11) the minimal market value of fertilizers - the smallest market value of fertilizers which developed by the corresponding types of fertilizers for the corresponding year, determined by local executive body of area, city of republican value, the capital by price analysis on fertilizers for setting standards of subsidies for them;

12) foreign producer of fertilizers - the nonresident of the Republic of Kazakhstan who registered fertilizers (except for organic) foreign production;

13) electronic agrochemical cartogram - the cartographic information showing degree of security of the soil of the field with nutritious elements, assimilable for plants, in color expression - humus, macro - and microelements, issued by republican public institution "Republican scientific and methodical center of agrochemical service of the Ministry of Agriculture of the Republic of Kazakhstan" or specialized (the Republic of Kazakhstan accredited according to the legislation) laboratory according to the agrochemical analysis of soils;

14) the web portal of "the electronic government" - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

15) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.";

state Item 7 in the following edition:

"7. Subsidies are paid in case of observance of the following conditions:

1) giving by agricultural producer or agricultural cooperative of the request in electronic form for receipt of subsidies for the acquired fertilizers at full cost in form, according to appendix 1 to these rules by means of the web portal of "the electronic government".

In case of acquisition of fertilizer at the reduced the price cost at producer of fertilizers based on the agreement the agricultural producer (agricultural cooperative) submits the translated application in electronic form about payment of the subsidies which are due to it in form, according to appendix 2 to these rules by means of the web portal of "the electronic government".

In that case, subsidies are paid to producer of fertilizers on condition of introduction by producer of fertilizers no later than thirty calendar days in the translated request of data on actually realized fertilizers according to Item 16 of these rules.

In case of untimely introduction by producer of fertilizers of data on actually realized fertilizers in the translated request at the scheduled time, the agricultural producer (agricultural cooperative) repeatedly submits the translated application.

At the same time in information system of subsidizing the list of agricultural producers (agricultural cooperatives) which does not realize fertilizers in the terms established by parts four and heel of the subitem 1) of Item 7 of these rules is created;

Information exchange of the web portal of "the electronic government" and information system of subsidizing is performed according to the legislation of the Republic of Kazakhstan;

2) registration of the application (the translated request) submitted by agricultural producer (agricultural cooperative);

3) availability of personal account in information system of subsidizing at agricultural producer (agricultural cooperative) which data are confirmed as a result of information exchange of information system of subsidizing with the state databases "Legal Entities" or "Physical persons". At the same time the translated request requires availability of personal account in information system of subsidizing at producer of fertilizers.

Availability of personal account in information system of subsidizing gives the chance to agricultural producer (agricultural cooperative) independently to perform registration of the request in information system of subsidizing, in this case application is not required, and it is considered given from the moment of such registration;
