About modification and amendments in the Law of the Republic of Armenia "About forced execution of court resolutions"

Article 1. Of May 5, 1998 "About forced execution of court resolutions" (further - the Law) the words "and term of its representation to execution" to exclude ZR-221 from Item 7 of part 1 of article 21 of the Law of the Republic of Armenia.

Article 2. To state article 23 of the Law in the following edition:

"Article 23. Issue of writ of execution and representation to execution:

1. The application for receipt of writ of execution is submitted within year if other is not provided by the law, since day when:

1) the court resolution took legal effect;

2) the Arbitration Court made the decision;

3) fixed term of prolongation of execution of the court ruling expired;

4) the court made the decision on recovery of the missed term of submission of the writ of execution to execution;

5) the decision of the Conciliator of financial system became obligatory for the parties.

2. In time, established by part 2 of article 18 of this Law, the court issues writ of execution, having sent it by urgent electronic method to service of forced execution.

3. The court based on the statement of the claimant submits within three-day term to it the copy of writ of execution of the forced execution sent to service.

4. If the obligation confirmed with court resolution assumes payment by installments or regular execution, then the writ of execution can be issued throughout obligation fulfillment, and also within year after the term established for obligation fulfillment.

5. The leaf of executive text can be provided within a month after its obtaining to forced execution.

6. Writs of execution with the requirements of claimants which are not satisfied owing to absence or insufficiency of property of the citizen keep the force before their execution.
