About modification of the Code of penal procedure of the Republic of Armenia

Article 1. To state the text of Article 204 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:
"1. If when carrying out pretrial investigation there is need of change or amendment of accusation, then the investigator shall bring charge repeatedly, observing the requirements established by Articles 202 and 203 of this Code and if the person accused absconds either vessels or its location is not established for other reasons, to make corresponding change or addition to the decision on involvement of person as the person accused, having made the new decision on attraction as the person accused.
2. If during pretrial investigation any part of accusation does not prove to be true, then the investigator the decision cancels this part of the brought charge, and announces it to the person accused and if the person accused absconds either vessels or its location is not established for other reasons, makes corresponding change to the decision on involvement of person as the person accused, having made the new decision on attraction as the person accused.".
Article 2. To state the text of article 259 of the Code in the following edition:
"1. Search of the person accused is establishment of its location, detention of the person accused and transfer to the order of the body performing production.
2. If the location of the person accused is not clear, or the person accused absconds, then the investigator the decision charges carrying out search to bodies of inquiry, having sent to two-day time to the last together with the specified solution of the copy of decisions on initiation of legal proceedings, on involvement of person as the person accused, election of measure of restraint, the requirement about check of criminal record searched, the passport copy searched or other identity document.
