About modification of the Code of penal procedure of the Republic of Armenia

Article 1. In Article 434 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code):
1) regarding 1 word "in seven-day time after receipt of the conclusion of the independent commission on questions of parole from punishment, replacement of unexpired part of punishment with milder pinishment (further-the independent commission) about circumstances of parole of the convict from punishment or the replacement of unexpired part of punishment with milder pinishment provided by parts 1.1 and 1.2 of Article 76 or part 1 of article 77 of the Criminal code of the Republic of Armenia" shall be replaced with words "in the cases and procedure provided by parts 5 and 6 of Article 115 of the Penitentiary code of the Republic of Armenia";
2) regarding 3 words "decision makings" shall be replaced with words "introductions in legal force of court resolution".
Article 2. In article 438 of the Code:
1) regarding 3.1 words "conclusion of the independent commission" shall be replaced with words "the petition of administration of the organization performing punishment or in the case provided by part 8 of Article 115 of the Penitentiary code of the Republic of Armenia - the claim of the convict", and words "to the independent commission and the organization performing punishment" - words to "Service of probation and criminal and executive service";
2) part 3.2 to recognize invalid;
Shall be replaced with words 3) in Item 3 of part 3.3 of the word "representative of the independent commission" "representatives of Service of probation and criminal and executive service";
4) regarding 3.5 words "the representative of the independent commission the conclusion" shall be replaced with words "representatives of Service of probation and criminal and executive service reports";
