About change of Resolutions of Council of Ministers of the Republic of Belarus concerning public-private partnership

According to article 9 of the Law of the Republic of Belarus of July 17, 2018 "About entering of amendments and changes into some laws of the Republic of Belarus concerning public-private partnership" the Council of Ministers of the Republic of Belarus DECIDES: No. 134-Z

1. Bring in the resolution of Council of Ministers of the Republic of Belarus of February 10, 1997 No. 71 "About formation of the Currency and credit commission of Council of Ministers of the Republic of Belarus" the following changes:

from subitem 2-1 of the word" (2009, No. 53, 5/29310)" to exclude the national register of legal acts of the Republic of Belarus;

in the Regulations on the Currency and credit commission of Council of Ministers of the Republic of Belarus approved by this resolution:

in Item 1 of the word" (2006, No. 69, 1/7495)" shall be replaced with words the national register of legal acts of the Republic of Belarus ", acceptance and obligation fulfillment on projects of public-private partnership, including account,";

to add subitem 5.1 of Item 5 after the paragraph of the sixth with paragraphs of the following content:

"about feasibility of acceptance and execution by the Republic of Belarus as the state partner of obligations in the project of public-private partnership, and also approval of acceptance and execution by administrative and territorial unit as the state partner of payment commitments in the project of public-private partnership if according to documents of the offer on project implementation of public-private partnership * the size of such obligations exceeds 1 million basic sizes on approval date (approvals) of these documents;

about approval for the purposes of carrying out limiting tender of the size of means of the republican budget for financing of agreement obligations about public-private partnership, and also the extreme size of means of the local budget for financing of agreement obligations about public-private partnership if according to documents of the offer on project implementation of public-private partnership the size of such obligations exceeds 1 million basic sizes on approval date (approvals) of these documents.

2. Bring in the resolution of Council of Ministers of the Republic of Belarus of May 27, 2014 No. 508 "About Interdepartmental infrastructure coordination council" the following changes:

2.1. the ninth Item 7 of the Regulations on Interdepartmental infrastructure coordination council approved by this resolution to state the paragraph in the following edition:

"considers and makes decisions on approval (the direction on completion, termination of work) concepts of projects on the infrastructure facilities offered to realization as projects of public-private partnership, except for projects, completely or mainly providing development and (or) implementation of information and telecommunication technologies;";

2.2. as a part of the Interdepartmental infrastructure coordination council approved by this resolution:

include in this list of Krecha Vladimir Ivanovich - the deputy minister of forestry, Smirnov Vitaly Alekseevich - the deputy minister of housing and communal services, Perminova Elena Aleksandrovna - the deputy minister of economy, having excluded from it L.Yu.Demyanik, A. 3.1. in the name and preamble of the word of "2015" shall be replaced with words "2015 No. 345-Z";

3.2. third Item 1 to state the paragraph in the following edition:

"Regulations on procedure for the organization and carrying out tender, and also negotiations concerning conditions of draft agreements on public-private partnership;";

3.3. The regulations on procedure for preparation, consideration and assessment of offers on projects implementation of public-private partnership approved by this resolution to be reworded as follows (are applied);

3.4. To be reworded as follows the regulations on procedure for the organization and carrying out tender at the choice of the private partner for agreement signature about public-private partnership approved by this resolution it (is applied);

3.5. in Regulations on procedure for maintaining the State register of agreements on the public-private partnership approved by this resolution:

state Item 2 in the following edition:

"2. For the purposes of this provision terms and their determinations in the values established in the Law of the Republic of Belarus "About public-private partnership" are applied.";

add Item 15 with part of the following content:

"The state partner within 5 working days from the date of receipt of the agreement on public-private partnership registered in the State register, the supplementary agreement to it sends them to the copy:

To the Ministry of Finance - in case of inclusion in the agreement on public-private partnership, the supplementary agreement to it payment commitments of the republican budget for financing of the project of public-private partnership (at any stage of its realization);

to regional executive committee (The Minsk Gorispolkom) - in case of inclusion in the agreement on public-private partnership, the supplementary agreement to it payment commitments of the local budget on financing of the project of public-private partnership (at any stage of its realization);

To the Ministry of Taxes and Tax Collection - in case of provision to the private partner or the commercial organization created by the winner of tender according to the legislation of the Republic of Belarus within the project of public-private partnership of privileges on tax payment (charges);

To the State Customs Committee - in case of provision to the private partner or the commercial organization created by the winner of tender according to the legislation of the Republic of Belarus within the project of public-private partnership of privileges on customs payment it agrees to the international treaties and acts constituting the right of the Eurasian Economic Union, to the legislation of the Republic of Belarus regulating customs legal relationship.".

4. This resolution becomes effective after its official publication.

Chapter 1 General provisions

1. This Provision determines procedure for preparation of offers on projects implementation of public-private partnership, their consideration and assessment.

2. For the purposes of this provision terms and their determinations in the values established in the Law of the Republic of Belarus "About public-private partnership" and also the following terms and their determinations are applied:
